▼ La violence des supporters est un phénomène malheureux lié au sport le plus populaire du monde. Malgré nombre d’efforts législatifs, des incidents, occasionnant souvent des dommages, continuent à se produire. Comme il est difficile de saisir directement les auteurs de ces actes de violence à titre individuel, la question a été soulevée de savoir si les clubs de football pouvaient eux-mêmes répondre de tels dommages à leur place. Différentes réglementations édictées par les organisations nationales et internationales de football prévoient l’engagement de la responsabilité des clubs, sans égard au caractère effectivement fautif de la conduite ou de la surveillance dans le cas concret de ces derniers. Au-delà du problème de la responsabilité disciplinaire se pose celui de la réparation des dommages causés avant, pendant et après les matchs de football. En effet, si la question de l’éventuelle responsabilité disciplinaire des clubs fait déjà l’objet d’un débat doctrinal qui se tient dans plusieurs ordres juridiques, celle de la réparation des dommages causés avant, pendant et après les matchs de foot est restée à l’arrière-plan. Cette étude s’intéresse dans l’ensemble à l’interaction entre les règlements disciplinaires des associations nationales et internationales de football au sujet de la responsabilité des clubs pour leurs supporters d’un côté, et le droit civil de l’autre. Afin de fournir un aperçu le plus complet possible, la responsabilité civile et disciplinaire des clubs y est examinée de façon comparative et d’un point de vue transnational et interactionnel. La présente étude vise à clarifier si et, cas échéant, dans quelles circonstances les lésés ayant subi un dommage en raison de violences de supporters peuvent se retourner contre le club de football pour en exiger la réparation. Elle fournit en outre des points de vue nouveaux au sujet de la position et de l’interaction des règlements internes d’organisations sportives – comme les normes disciplinaires sur la responsabilité – et leur application en droit civil. Par cette recherche, l’auteure espère fournir un aperçu de la manière dont ces règlementations diverses interagissent entre elles et en favoriser la compréhension, afin de permettre à futur la prise de décisions responsables concernant la mise en oeuvre des règles existantes ou la création de nouvelles normes régissant la question de la responsabilité des clubs de football pour les actes de violence commis par leurs supporteurs. ▼ This thesis seeks to answer the primary question as to whether Product Liability Claims are socially desirable by reference to three Product Liability case studies and a survey of 132 archived Product Liability claims. These constitute a representative random sample of Product Liability cases handled by the Author’s Legal Practice. This practice has provided a window through which serious failings are identified in (i) the strict liability based Product Liability Directive; (ii) tort itself as a mechanism for compensating injured persons; and (iii) the procedural infrastructure in which claims are made, as recently reformed in accordance with Lord Justice Jackson’s recommendations. This thesis tests Product Liability claims against the objectives of tort: deterrence; corrective justice; retribution and vindication; distributive justice and compensation. It is found that Product Liability claims fail to meet the defined standard of social desirability. There is nothing special about products to necessitate or justify a bespoke system of liability. Product Liability claims for damages represent in microcosm the broader picture of personal injury claims as a whole. This thesis highlights the failings of a system which relies heavily on gambling upon outcomes; perpetuates a ‘have a go’ culture; rewards the lucky few; builds in an unacceptable element of moral hazard and tolerates and generates the costs of a high volume of claims which serve no practical or legal purpose. It is concluded that 1. The Product Liability Directive was introduced as an emotive response to the Thalidomide tragedy but it would fail to provide a remedy in a similar disaster. Instead it treats sufferers of minor mishaps as victims and contributes to a litigation industry that inculcates in society a false and unnecessary sense of entitlement. 2. The Product Liability Directive should be repealed as a flawed and misconceived piece of legislation that fails to achieve its key goal of protecting consumers and harmonising the law. 3. Support is found in this practical research for much of what Atiyah advocated in his seminal work The Damages Lottery. The possibility of an all-embracing no-fault liability system should be reconsidered subject to strict controls, including thresholds, to ensure that it compensates and rehabilitates only those with genuine needs. 4. A first party insurance market would have to develop to fill the gaps.

▼ To say that a person is morally liable to some harm implies that he would not be wronged by suffering it. The paradigmatic cases of liability are those in which an attacker is harmed to prevent a threat of wrongful harm that he poses. In these standard cases, we say that the unjust attacker, by virtue of his wrongful behavior, i.e. his posing the wrongful threat, makes himself morally liable to defensive harming by his potential victim. He becomes liable to the harm since, by virtue of his wrongful behavior, he forfeits his right against being harmed in this way. And this rights-forfeiture explains why the attacker is not wronged by the harm. The standard cases are consistent with the following three principles on liability: (1) instrumentality principle—one can be liable only to harm that secures some external good (e.g. the prevention of wrongful harm); (2) responsibility principle—one can be liable to harm to prevent only those threats for which one is sufficiently morally responsible; (3) causality principle—one is sufficiently morally responsible for a threat only if one causally contributes to it. Despite the plausibility of these principles, support for them has been eroding due to recent arguments in the literature claiming that ineffective threats like apparent threats, culpable attempters, and complicit threats can be liable to harm. This dissertation is comprised of three separate articles, each aimed at refuting arguments for liability of the various types of ineffective threats just mentioned. In Article 1, “Liability, Instrumentality, and Apparent Threats,” I argue that, although it might seem that apparent threats are liable to harm, the theoretical cost of this position gives us good reason to reconsider this intuition, for if apparent threats are liable, we must reject the instrumentality principle. I then argue that the more plausible position is that apparent threats are not liable to be harmed, and that this position is consistent with their not having the right to defend themselves against the wrongful harm posed by their apparent victims. In Article 2, “Liability, Responsibility, and Culpable Attempters,” I argue that, although it might be true that culpable attempters would not be wronged by harm to avert a threat for which they are not responsible, this claim is best explained by desert-based reasons for harming. I argue then, that culpable attempter cases give us no good reason to reject the responsibility principle of liability. In Article 3, “Ineffective Threats, Complicity, and Liability by Omission,” I argue that, although it is plausible that some complicit threats could be liable to serious harm, there is a better explanation for their liability than their complicity. I argue for an explanation based on responsibility by omission, which, I claim, is better able to handle what I call the proportionality problem for complicitous liability. This study seeks to investigate the extent to which the state fails to comply with its constitutional and legal duties, and the impact of this failure on democracy. The study determines the effect of such failure and assesses the effectiveness of existing compliance mechanisms in ensuring the state fulfills its constitutional and legal duties. The duties imposed on the state must be complied with to ensure the legitimacy of the Constitution remains intact. State compliance with these duties forms an essential foundation of the Constitution. It is accepted in this study that the manner in and extent to which the state fails to comply with its duties impacts the status of the Constitution and the development of democracy in South Africa. There are two ways in which the state may fail to comply with its duties: 1. The first instance is where the state bona fide misinterprets legislation. 2. The second instance is where the state negligently ignores its duties or wilfully disregards its duties or takes on “imagined powers”. This study concerns itself with this second instance of non-compliance. The question not only concerns the extent of state non-compliance with its duties. The question also becomes, what are the ramifications if the state does not comply with its duties? What would be the consequences if the state wilfully, with mala fide intent or by the use of “imagined powers” neglects or ignores its duties? What would be the effect on the development and sustainability of democracy in South Africa? What are the existing compliance mechanisms and are they effective enough to ensure state compliance with its duties? The study endeavours to explore these questions. The study looks at a series of court cases illustrating the extent to which the state has so far failed to act in compliance with its duties. The study attempts to determine whether such non-compliance was merely a mistake or whether the state acted with some form of wilfulness or neglect. The study looks at the existing mechanisms and watchdogs that ensure state compliance with the Constitution and briefly examines whether they are effective. Other possible mechanisms that may strengthen control over state compliance are also considered. The study first looks at the duties of the state and the existing control mechanisms. Then a selection of cases are analysed to determine in what manner and to what extent the state is failing to comply with its constitutional duties. The study then assesses the current control mechanisms to determine whether they are effective in enforcing state compliance with its duties. Lastly, the study examines other possibilities and alternative mechanisms that may be introduced to secure state compliance.

Vienas iš dažniausiai padaromų nusikaltimų ne tik Lietuvoje, bet ir kitose pasaulio valstybėse – vagystė. Mūsų valstybė šio nusikaltimo kontrolei ir prevencijai skiria nemažą dėmesį, dažnai tobulina ir keičia teisės normas, numatančias baudžiamąją atsakomybę už vagystę. Šios normos ne visada būna tinkamai inkorporuotos į visą Lietuvos Respublikos baudžiamojo kodekso normų sistemą, ir tai sąlygoja praktinio taikymo sunkumus, problemas atribojant panašias nusikalstamas veikas nuosavybei bei nevienodą teismų praktiką tokiose bylose, todėl ši tema aktuali tiek teoriniu, tiek praktiniu aspektu. Šio darbo tikslas buvo atskleisti vagystės kaip socialinio reiškinio esmę ir išnagrinėti baudžiamosios atsakomybės už ją reglamentavimo problemas Lietuvos Respublikos baudžiamajame įstatyme. Šiam darbui buvo iškelti šie uždaviniai: panagrinėti baudžiamosios atsakomybės už vagystę sampratos bei ją numatančių įstatymų raidą Lietuvos Respublikoje ir pasaulyje; atskleisti vagystės sudėtį ir pagrindinius jos požymius Lietuvos Respublikoje bei užsienio šalių baudžiamuosiuose įstatymuose; išanalizuoti ir atskleisti vagystę kvalifikuojančius bei itin kvalifikuojančius požymius Lietuvos Respublikos baudžiamajame kodekse; aptarti bausmės už vagystę pagrindinius aspektus bei problematiką Lietuvos Respublikoje; atskleisti vagystės ir kitų nusikalstamų veikų nuosavybei skirtumus bei dažniausiai pasitaikančias praktikos problemas, taikant šias veikas reglamentuojančius įstatymus. Theft is one of the most frequently committed crimes not only in Lithuania, but also in other countries all over the world. Lithuanian legislator pays quite much attention for the prevention and control of this crime, regularly improves and amends the laws, prividing a criminal liability for theft. These legal regulations are not always properly incorporated into the entire system of regulations of the Lithuanian Criminal Code, which leads to difficulties of their practical application, problems disassociating similar criminal acts to property from different judicial proceedings in such cases. That makes this topic relevant for both – theoretical and practical aspects. The objective of this work was to reveal the conception of theft as a social phenomenon and to explore the problems of regulation of criminal liability for theft in the Lithuanian Criminal Code. L'étude croisée de l'assurance et de la responsabilité civile du fait des produits défectueux permet d'analyser les spécificités des dispositions des articles 1386-1 et suivants du Code civil avec les différents principes de la responsabilité civile qu'il complète, ainsi que les spécificités du droit des assurances. La cohérence de l'ensemble des dispositions nouvellement insérées au Code civil est ainsi appréciée, en déterminant plus précisément le contour de leur mise en œuvre et examinant, au regard de la jurisprudence, les possibles extensions du domaine d'application. La mise en œuvre de ces nouvelles dispositions a pu être source d'incertitudes, qu'elles portent notamment sur la preuve du défaut de sécurité du produit ou encore du respect du la brièveté des délais imposée par le législateur. De manière corrélative, l'application de mesures spécifiques au droit des assurances nécessite le respect de plusieurs exigences, qu'elles soient relatives à la déclaration du sinistre ou encore aux modalités d'indemnisation de l'assureur.

The crossover study of insurance and civil liability related to faulty products yields an analysis of the specific provisions set down in articles 1386-1 and the following of the Civil Code along with the different principles of civil liability that they complete and the specificities of insurance law. The coherence of the new set of provisions recently added to the Civil Code is thus considered through a more precise outlining of their implementation and by examining, within the light of case law, the possible extensions of their scope of application. The implementation of these new provisions has been a source of uncertainty, regarding the proof a product's safety defect or compliance with delays imposed by the legislator. In a correlative manner, the application of measures specific to insurance law require that a number of demands be met, relative to the notification of a claim or the compensation methods used by the insurer.

▼ This research aims to study the effects of legal liability rules on auditing quality in order to devise and implement a guideline for the optimal liability rules that can be applied to the auditing profession within society, and thus encourage investment. In an emerging market like Kuwait state, there is a weakness in the legal system, which may cause users to place less reliance on financial reports and auditing services. This environment does not encourage investment. The position in Kuwait state will be studied as an example of how emerging economies can add to the understanding of the role of the auditor, for the purposes of improving audit quality and encouraging a greater amount of investment. Where this position can be understood, this study gives a strong impression of how the legal liability of external auditors can impact on the auditing quality and, importantly, the chances of obtaining investment. For this reason the study is applied in Kuwait state. This research differs from the other literature in several important ways. First, the study has been performed in an environment of weak governance. Second, it studies the effects of the civil legal liability system from two views at the same time, so the research is carried out in relation to two different sides: first, the demand side of the auditing services represented by the users of financial information; and second, the supply side of the auditing services represented by the auditors. This has been done through two questionnaires, one distributed for each side. The results of users' questionnaire revealed that the existence of civil legal liability will increase the demand for auditing service. Also, consideration is directed towards the main determinant of auditing quality, which is the legal liability system, more so than other factors. As well as, through increasing auditor liability, trust in financial information will be enhanced, subsequently prompting investment within society. Moreover, the users, besides their needs for auditing services, require auditors to provide collateral for their investment process in order to increase their investment level. On other side, the results of auditors' questionnaire detected that the auditors hold the view that the demand for auditing services by companies will not be affected by the existence or non-existence of the liability rules. However, auditors believe that the existence of legal liability rules will make financial statement users more trustful in financial information, thereby increasing the number of users of audited financial reports. Also, the auditors do not agree that their liability should be increased since this will make auditing services more costly through the need to collect more evidence, increase the time of auditing, increase the sample size, etc. The increase in liability will also limit their acceptance of risky clients, make them increase their efforts, and due care. ▼ This PhD research is situated in the academic literature on civil society organisations (CSOs) accountability with a focus on self-regulation and beneficiary accountability It investigates normative developments occurring in civil society self-regulation by measuring its effectiveness against the normative expectations set by CSOs. Simultaneously, it questions why CSOs are not getting it right when it comes to dealing with beneficiary accountability. It focuses on a checklist of indicators (CDV) developed by Italian CSOs in the aftermath of the scandal "Mafia Capitale" when threatened by strict government regulation and by critical public opinion. The empirical side of this PhD research relies sequentially on three different sets of methodological tools. This multilayered methodology consists in: a) the application of a blueprint developed by the One World Trust London to test the effectiveness of self-regulation against its own objectives; b) an explaining-outcome process-tracing aimed at providing a sufficient explanation to the fact that the matter of beneficiary accountability is usually ignored within self-regulation; c) a multiple-case study analysis on beneficiary accountability (transparency, participation and complaints procedure) at an intra-organisational level. Empirical data have been gathered during fieldwork in Rome (2017). This PhD thesis contributes to the academic and societal discourse on civil society self-regulation and accountability in several ways. It constitutes the first comprehensive study on CSO's accountability and self-regulation in Italy. It enriches the academic debate on selfregulation by providing a brand-new theoretical model to explain non-compliance together with a series of policy proposals aimed at guiding current discussions on the reform of self-regulation. It provides a minimally sufficient explanation to the fact that CSOs systematically fail to address the matter of beneficiary accountability through self-regulatory instruments, coupled with an explanation of the circumstances under which the matter is likely to be incorporated into selfregulatory norms.

▼ Lötz and Du Plessis sum up the problem at hand most succinctly in their stating that “the relevant question is whether electronic contracts of sale can fulfil the general, legal requirements for the conclusion of a valid contract, and also where and when such contracts are (deemed to be) concluded”.2 In light of this statement, consider the following schematic representation of all the parties and their relationships, as typically occurring during the electronic contracting process: This statement succinctly sums up a single aspect of this problem, the so-called “contracting phase”. Following the traditional thought pattern, all aspects leading up to the point of conclusion need to be assessed and critically discussed as a failing or miscommunication in any one of the traditional requirements for the conclusion of a valid contract may later in the contractual relationship affect consensus and thus conclusion. This second phase “remedies and liability” refers to the situation where consensus is defective for one or other reason stemming from a failure in the internet/network services offered by the Internet Service Provider. A practical example of this may be: A and D have concluded pre-contractual negotiations and stand on the brink of consensus. A has signed the agreement and has forwarded same to D by means of e-mail. As far as A is concerned, the contract is concluded and he/she makes arrangements to fulfil of his/her obligations. D does not receive the signed agreement from A due to a failure on the part of his/her Internet Service Provider (C) – the server crashed and as a result he/she has no knowledge of A’s acceptance. D therefore concludes a contract with a third party for the same goods that form the subject of the contract with A and performs in terms of same. In these circumstances A has suffered economic loss due to his/her preparation to perform alternatively, full performance in terms of a contract he/she believed to be concluded. It goes without saying that neither A nor D are responsible for the loss A has suffered. The obvious question is then who is responsible for A’s loss? This work aims to assess firstly, the nature and the scope of possible remedies available to A to redress his/her loss, and secondly, the extent to which the Internet Service Provider can be held responsible for the failure of the communication medium. These issues will be discussed against the backdrop of the general principles of the law of contract and their application to this new and integral component in economic transactions. ▼ This dissertation critically interrogates the assumptions, agendas and relations of power that shaped Bill C-45, An Act to Amend the Criminal Code (criminal liability of organizations), revisions to the Criminal Code of Canada aimed at strengthening corporate criminal liability. Colloquially referred to as the Westray bill, the legislation was passed in the fall of 2003 in response to the deaths of twenty-six workers at the Westray mine in 1992, a disaster caused by unsafe and illegal working conditions. Using twenty-three semi-structured interviews with individuals with knowledge and insight into the evolution of Canada’s corporate criminal liability legislation, and transcripts from Canada’s Parliament regarding the enactment of this law, the dissertation critically explores the constitution of corporate criminal liability – the factors that produce legal categorizations of corporate harm and wrongdoing. Of particular interest are the official discourses that shaped conceptualizations of corporate crime and corporate criminal liability and how these discourses correspond to the broader social-political-economic context. Drawing theoretical inspiration from Foucauldian and neo-Marxist (Althusserian) literatures, the dissertation argues that particular legal, economic and cultural discourses shaped, but did not determine, corporate criminal liability in Canada. In turn, these discourses are constitutive of class struggles over the role of the corporate form in extracting surplus labour and accumulating capital, the results of which helped stabilize, reproduce and transform the class-based capitalist social formation. Overall, the dissertation suggests that the assumptions that animated Canada’s corporate criminal liability legislation and the meanings inscribed in its provisions throw serious doubt on its ability to hold corporations legally accountable for their harmful, anti-social acts. There is little reason to believe that the Westray bill will produce a crackdown on safety crimes, or seriously challenge corporations to address workplace injuries and death. While it will hold some corporations and corporate actors accountable – and thus far it has been the smallest and weakest – the primary causes of workplace injury and death (e.g., the tension between profit maximization and the costs of safety and the relative worth of workers/employees versus owners and investors) will continue.

The starting point of this research is the observation that the protection of human rights and the prevention of human rights atrocities can only take place through a universal system of different means of accountability which create enough deterrence for the future state or individual offender. This research consists of four parts: Part A explores and outlines the different existing ways and means of traditional human rights protection under the international and regional human rights regimes. It focuses on the aspect of victim protection from human rights violations through protective means available under the different human rights regimes. Part A concludes that the existing means and ways of protecting human rights are by far not sufficient to ensure the compliance of states with the existing provisions on human rights protection and that the protection of human rights remains an unfinished chapter of international law. Parts B and C analyze the evolving approach to hold states and individuals directly accountable for gross human rights violations, via the means of criminal and/or civil responsibility. Part B explores the possibilities of human rights protection by the means of criminal prosecution. It outlines the development of the concept of criminal responsibility from the days of Nuremberg to the present International Criminal Court in The Hague. The main focus is on domestic criminal procedures as a supplement and possibly alternative to international prosecution. This part concludes with the observation that the present mechanisms and means available under the existing international and domestic jurisdictions fail to establish individual criminal accountability at the necessary global scale and therefore fail to deter the commission of future genocide. Part C explains the necessity to establish an international system of civil liability for human rights atrocities as a supplement and (even) alternative to the existing mechanisms of accountability. The present possibilities for the individual victim to obtain financial redress for his suffering under international law are outlined and discussed. The further option of asserting civil legal action for human rights violations under domestic jurisdictions is scrutinized and evaluated with a special focus on the USA as the state which has so far the strongest adjudication of human rights claims. This part concludes with the finding that the individual victim of human rights violations still lacks the necessary forum with the respective judicial means to hold the perpetrator financially liable for his human rights violations. Part D introduces a draft Statute on a (future) Convention on Individual Civil Liability for Human Rights Atrocities as a supplement for the existing ways of human rights protection. Ова докторска теза је посвећена разматрању института одговорности правних лица за кривична дела. Увођење правила по ком за кривична дела не одговарају само физичка већ и правна лица која су стекла или могла стећи корист од извршења конкретног дела, представља важан новитет у правним системима који почивају на европско-континенталној правној традицији. Кривична законодавства европских земаља (изузимајући поједине земље, попут Немачке и Италије, које се и даље принципијелно противе кажњавању правних лица кривичним санкцијама) су се, у другој половини XX века, а нарочито у последњих тридесетак година, махом реформисала како би у систем кривичног права уврстила и правила о одговорности и санкционисању корпорација. Чињеница да се велики број земаља одлучио за поменуте законодавне промене је последица објективног сагледавања криминолошке реалности, која недвосмислено показује како се у име и за рачун правних лица учестало врше тешка кривична дела, која производе озбиљну штету државама, друштву и појединцима и представљају велику опасност по савремени свет. Проблем криминалитета правних лица и проналажења адекватног нормативног оквира за његово сузбијање препознат је стога и на глобалном и регионалном нивоу, о чему сведоче бројне конвенције које захтевају од држава потписница кажњавање правних лица ефикасним и одвраћајућим санкцијама. Српско законодавство је прихватило принцип кажњивости правних лица за кривична дела тек крајем 2008. године, након што је већина европских земаља (као и све земље Западног Балкана) то већ учинила. Ипак, четири године касније, није забележен ниједан судски поступак против правног лица окривљеног за кривично дело, по чему заостајемо не само за земљама ЕУ, већ и неким државама у региону. Имајући ово у виду, остаје неизвесно је да ли је, у којој мери и на који начин, наш правни поредак у стању да адекватно одговори на изазове које поставља феномен криминалитета правних лица. Наведени проблем се може разложити на низ питања, дилема и недоумица, на која правна и њој сродне науке требају да одговоре, почев од принципијелних (оправданост делимичног одступања од традиционалних начела кривичног права) до крајње практичних (могућности ефикасне примене законских норми и постизања ефеката генералне и специјалне превенције према колективитетима).

Šio magistro baigiamojo darbo objektas — vežėjo atsakomybės už krovinio praradimą, sugadinimą ar pavėlavimą pristatyti ypatumai. Darbo tikslas yra išanalizuoti ir sistemiškai pateikti vežėjo atsakomybės ypatumus nacionalinėje bei tarptautinėje teisėje. Vežimas keliais yra vienas prieinamiausių krovinių gabenimo būdų. Dažnas šio transportavimo būdo pasirinkimas sąlygoja iš vežimo santykių kylančių ginčų sprendimo problematiką, ypač susijusią su vežėjo atsakomybe už krovinį. Atkreiptinas dėmesys, jog nacionalinė teisė ir CMR konvencija panašiai reglamentuoja vežėjo atsakomybės klausimus, nors ir pasižyminčius tam tikra specifika nacionalinės teisės atžvilgiu. Todėl išskirtini bendriausi ypatumai vadovaujantis CMR konvencija. Pažymėtini vežėjo atsakomybės pradžios ir pabaigos už krovinį momentai, privaloma pretenzijų pateikimo procedūra vėluojant pristatyti krovinį, griežta vežėjo atsakomybė už padarytus nuostolius, 8,33 SDR dydžiu ribotas nuostolių atlyginimas, nors nustatomos išimtys, kai jis netaikomas. Be to, vežėjas gali būti atleidžiamas nuo pareigos mokėti kompensaciją tik Konvencijoje nustatytais išimtiniais atvejais. Dauguma paminėtų pagrindų vertintini kaip palankūs vežėjui, nes suteikia išimčių dėl griežtos atsakomybės įtvirtinimo. Turime pažymėti, kad nacionalinė teisė šių ypatumų atžvilgiu yra ne tokia reikli ir numato sąlyginai palankesnę vežėjo padėtį. The subject of this Master’s final work is carrier‘s liability for loss, damage or delay in delivery of a cargo. The purpose of the work is to analyze and introduce systematically the peculiarities of carrier’s liability in national laws, as well as in CMR convention. Transportation by road is one of the most available means of conveyance of cargos. Often this way of transportation determines problems in litigation, especially the ones of liability of a carrier. We should point out that that there are similarities in regulation of carrier’s liability in national law and in CMR convention, though there still are same specifics. Therefore we are emphasizing common peculiarities according to the Convention. To mention is the moments of beginning and ending of the liability, mandatory reservations, strict liability of a carrier, limitation of 8,33 SDR in extent of liability. What is more, a carries should be relived of paying compensation only accordingly to exceptions. In addition, national law is more propitious and estimates a lot favorable position of a carrier. Because of that may occur a gratuitously privileged use of laws of carrier’s liability when applying national law. Liability of a carrier becomes specific because of risky actions. If there were not favorable conditions, contracting parties may be put in an unequal position and their interests or rights may not be ensured.
