Les questions de l'usage de l'espace public sont devenues un sujet de recherche important dans le passé récent. La recherche plutôt opérative a mis en avant un ensemble convaincant de recommandations de dessin et de gestion pour améliorer l'usage des espaces, mas elle a à peine réussi à approcher la question comme un problème de politique et planification urbaines. Ce projet de recherche essaiera de contribuer pour le replacement du problème à une échelle urbaine, à travers la comparaison de trois processus de production de l'espace public à l'échelle urbaine, notamment Lyon, Louvain-la-Neuve et Lisbonne. Dans ces trois terrains, des différentes façons de prendre en compte l'usage ont été suivies et cette diversité fait partie de la problématique. Cette recherche adopte une approche inductive au sujet, cadrée par des lectures dans l'intersection de la sociologie de l'action et des études de politiques publiques, qui cherchent expliquer les résultats de l'action collective par des analyses approfondies de leurs processus. Cependant, elle maintient un repère géographique dans la mesure où elle est concernée aussi par la spatialisation des politiques publiques, c'est-à-dire les espaces produits par les différents processus et les dynamiques d'usage qu'y sont présentes

Issues of public space use have become a paramount subject of research in the recent past. While research of an overtly operative outlook has convincingly put forward design and management recommendations for improving the use of public spaces, it has struggled in approaching the issue as the scope of urban policy and planning. This research project aims at contributing to re-placing the problem at an urban scope. It will do so by comparing three very different policy and planning processes which, at an urban scale, explicitly put forward use as a main objective of public space production, namely Lyon, Louvain-la-Neuve and Lisbon. The diversity of what 'taking use into account' might mean in each case study is a part of the research problem. This research adopts an inductive approach to the subject, framed by readings in the intersection of pragmatic sociology, policy and economics/management studies which suggest the explanation of policy outcomes by in-depth analyses of the processes leading to them. However, it maintains a geographical standpoint as it is concerned, as well, with the “spatialization of public policies”, i.e. the spaces that are actually produced by said processes and the dynamics of use taking place therein

La thèse a pour objet de démontrer l'émergence du principe de nécessité dans l'action normative au niveau de l'Union européenne. Après une partie concernant la notion générale de nécessité et le rôle des principes dans l'ordre juridique de l'Union, le cadre juridique des traités est examiné à l'aune du principe de nécessité. L'analyse est faite sur base des dispositions pertinentes des traités ainsi que des actes législatifs adoptés par le législateur de l'Union et des critères qui ressortent de la jurisprudence de la Cour de justice en matière pénale. Une distinction est opéré entre (1) les dispositions concernant la coopération judiciaire en matière pénale et la procédure pénale (article 82 TFUE), (2) le droit pénal autonome (article 83, paragraphe 1, TFUE), et (3) le droit pénal accessoire (article 83, paragraphe 2, TFUE) de l'Union. Des documents concernant les prises de position de certaines institutions de l'Union sont également examinés. À l'issue de l'analyse, l'on conclut à l'émergence d'un principe de nécessité, à la lumière aussi de l'évolution de la pratique législative.

This thesis has as its purpose to demonstrate the appearance of the principle of necessity in the legislative action of the European Union in the field of criminal law. After a first part which concerns the general notion of necessity and the role of principles in the Union's legal order, the legal context of the EU Treaties is examined in the light of the principle of necessity. The analysis is made on the basis of the relevant provisions of the Treaties as well as on the basis of the legislative acts adopted by the Union's legislature and takes into account the criteria coming from the case law of the Court of Justice in criminal law related matters. A distinction is made between (i) the provisions concerning judicial cooperation in criminal matters and criminal proceedings (Article 82 TFEU), (ii) autonomous criminal law (Article 83(1) TFEU), and (iii) ancillary criminal law (Article 83(2) TFEU) of the European Union. A number of documents concerning the positions taken by some Institutions of the European Union are also analysed. In the final analysis, it is concluded that the principle of necessity appears in the Union's criminal law, also in the light of the evolution of the legislative work.

Os pontos de encontro entre a poesia de Cesário Verde, o surrealismo e a poesia de Alexandre ONEILL são muitos. [en] The aim of the present dissertation is to analize Cesário Verdes poetry, focusing its surrealizing points and its influence upon Alexandre ONEILLs poetry. For this reason, the present work comprehends the historical period between the second half of the XIX century and the second half of the XX century. There are many commun points among Cesário Verdes poetry, the surrealism and Alexandre ONEILLs poetry. The present work considers only those points that are more relevant, such as the ones which present kind of resistance to the opression that takes place in the urban area.
