▼ Subsidiarity is a principle in Catholic social thought
that informs the distribution of authority among levels of the
political and social order. First expressly articulated by Pope
Pius XI in his 1931 encyclical letter Quadragesimo Anno, the roots
of the concept go back further to Pope Leo XIII and to Thomistic
social theory. But
subsidiarity is frequently
subject to the
criticism that it is vague and indeterminate and thereby an
ineffective guide to politics and public policy. Much of the
discussion of
subsidiarity proceeds as though the principle were
merely one of devolution of authority to the local level. Moreover,
the principle is often taken to be a procedural norm, counseling
"small is better" regardless of the underlying substantive question
to which one is applying the principle of
subsidiarity. The thesis
of this dissertation is that it is only through an adequate
examination of concrete policy issues that
subsidiarity's import
can be fully measured and appreciated and only by asking what the
common good requires in particular instances through the exercise
of political prudence that the proper distribution of authority can
be determined. The account of
subsidiarity advanced in the
dissertation is one of "functional pluralism," denoting that
subsidiarity focuses upon the multiple ends of differentiated
political societies and thereby seeks to determine the goods they
pursue and the means that are properly adapted to those ends. The
dissertation argues that federalism and localism as informed by the
principle of
subsidiarity provide a safeguard for fundamental
concerns of Catholic social thought, such as human rights and the
common good. After examining the concepts of
subsidiarity in
Catholic social thought and federalism in American constitutional
law and considering their relation, the dissertation discusses
three areas in which a richer and analytically sharper
understanding of the principle of
subsidiarity can make an
important contribution to policy debates over the role of
federalism and localism in law and public policy. The three policy
questions addressed in the dissertation are physician-assisted
suicide, FDA preemption, and school finance.

▼ La tesi ha ad oggetto il controverso rapporto tra i poteri pubblici, latu sensu intesi, e i soggetti privati. In particolare, si è analizzato, nel primo capitolo, l approccio della dottrina al ruolo dei soggetti privati negli atti di amministrazione pubblica, indagando in particolare l evoluzione del principio di sussidiarietà orizzontale. Nel secondo capitolo si è proceduto ad una analisi di alcune fattispecie concrete, con particolare attenzione alla giurisprudenza nazionale e comunitaria. Si è potuto così constatare che il diritto amministrativo adopera moduli dinamici, che consentono in qualche caso al privato di adottare esso stesso provvedimenti amministrativi, o di avere la competenza istruttoria in casi specifici di attività discrezionale.

▼ In the tumultuous political climate following Brexit, the European integration lives on borrowed time. With the ever-increasing need for democratic legitimacy on the EU stage, the ‘Early Warning Mechanism’ is viewed by many as the last salvation. Since its introduction to the EU with the Treaty of Lisbon of 2007, it has been used to trigger a subsidiarity test three times, issuing so called ‘yellow cards’ to the Commission, and forcing it to review its proposal on grounds of subsidiarity. However, the Commission has ruled in favor of itself at every instance, making both the EU and the Member States question its efficiency. By presenting the three yellow cards, this study aims to scrutinize the Commission’s and the Member States’ involvement in the EWM while discussing their views on subsidiarity as a whole.

▼ La subsidiarité joue, dans le registre du droit public européen, sur deux paliers : celui de la répartition des compétences entre l'Etat et les collectivités territoriales et celui des relations entre les pouvoirs publics et les personnes privées. Applicable à la répartition des compétences entre les autorités centrales et décentralisées d'un Etat, la subsidiarité territoriale est susceptible de justifier la politique de décentralisation et les transferts de compétences subséquents, et de renforcer ainsi l'autonomie locale. Notre thèse cherche à vérifier cette hypothèse, dans le contexte engendré par l'introduction du principe de subsidiarité dans le texte constitutionnel français, à la suite de la révision constitutionnelle de l'année 2003. Le concept d'autonomie locale est, d'abord, circonscrit. Ensuite, sont analysés les changements que la subsidiarité apporte aux limites et au contenu de l'autonomie locale française. Une démarche similaire est appliquée à l'analyse du système juridique roumain, dans le contexte où le principe de subsidiarité est présent dans certains textes normatifs infra constitutionnels régissant les services publics et l'administration publique locale.
In European public law, subsidiarity plays its role at two levels : that of the distribution of competences between the State and the local government units and that of the relations between public authorities and individuals. Applicable to the distribution of competences between central and local decentralized authorities in a State, territorial subsidiarity is likely to justify the decentralization policy and the transfers of competences implied by it, and to enhance, therefore, local autonomy. Our dissertation aims at checking this hypothesis, in the context generated by the introduction of the principle of subsidiarity in the French Constitution, subsequent to its revision in 2003. First, the concept of local autonomy is circumscribed. Then, the limits and the content of French local autonomy are analyzed, from the point of view of the ways in which they have been influenced by subsidiarity. A similar approach follows for the Romanian legal system, in the context in which the principle of subsidiarity appears in certain statutes governing the public services and the local public administration.

▼ Este trabalho de investigação foi motivado pela preocupação em analisar a governação da área metropolitana de Lisboa como um fator determinante na resposta política aos problemas, desafios e oportunidades específicos deste território. O poder público existe para dar respostas assertivas e suficientes às exigências e necessidades da população que serve. O motivo essencial desta investigação é, desta forma, verificar se a solução governativa vigente na área metropolitana de Lisboa é capaz de responder com eficácia e eficiência às necessidades dos residentes e utilizadores deste extenso espaço urbano.
As competências de âmbito metropolitano encontram-se distribuídas por vários organismos, entre os quais municípios, ministérios, comissão de coordenação e desenvolvimento regional, órgãos próprios da área metropolitana, empresas públicas e entidades privadas. Uma boa governação, ou governança, deste espaço exigiria uma eficaz coordenação entre estes diferentes atores, exigiria que não houvesse sobreposição de funções e, por fim, que cada uma das competências fosse desempenhada pelo ator territorial mais capaz de a desempenhar com elevado grau de eficiência. Concluiremos que esse nível de eficiência não está garantido na arquitetura institucional que gere a área metropolitana de Lisboa, e que as alterações feitas às leis fundamentais da distribuição de poderes não têm tido o efeito de alterar um paradigma que já se mostrou claramente inoperacional.
As cidades ocupam, nos dias de hoje, uma posição central na organização do sistema global e das economias, tomando um lugar que foi, outrora, ocupado pelos impérios ou pelos Estados-nação. Trata-se essa mudança contemporânea de um efeito direto do complexo processo de globalização. Esse posicionamento estratégico das cidades gerou importantes mudanças na sua estrutura e no próprio conceito de cidade. Essas mudanças, porém, necessitavam ser acompanhadas de mudanças no modelo de governação das cidades, pois diferentes realidades necessitam de diferentes soluções de governo. O desenho de um modelo institucional eficaz para dar as respostas necessárias à área metropolitana de Lisboa exige um conhecimento profundo do território em estudo. Compreender as cidades contemporâneas e conhecer as propostas institucionais sugeridas por diferentes investigadores ao longo das últimas décadas é o primeiro passo desta investigação, depois do qual procuraremos analisar a metrópole de Lisboa, o modelo até então seguido, para sermos, por fim, capazes de o sujeitar a uma crítica construtiva que vise melhorá-lo para benefício da população e do próprio país.

▼ Uganda, like many African countries in the 1990s, adopted decentralisation as a state reform measure after many years of civil strife and political conflicts, by transferring powers and functions to district councils. The decision to transfer powers and functions to district councils was, in the main, linked to the quest for democracy and development within the broader context of the nation state. This thesis' broader aim is to examine whether the legal and policy framework of decentralisation produces a system of governance that better serves the greater objectives of local democracy, local development and accommodation of ethnicity. Specifically, the thesis pursues one main aim: to examine whether indeed the existing legal framework ensures the smooth devolution process that is needed for decentralised governance to succeed. In so doing, the study seeks, overall, to offer lessons that are critically important not only for Uganda but any other developing nation that has adopted decentralisation as a state-restructuring strategy. The study uses a desk-top research method by reviewing Uganda's decentralisation legal and policy frameworks. In doing so, the thesis assesses decentralisation's ability to deepen democracy, its role in encouraging development and its ability to accommodate diversity. After reviewing the emerging soft law on decentralisation, the thesis, finds that Uganda's legal framework for decentralisation does not fully enable district councils to foster democracy, facilitate development and accommodate diversity. The thesis argues that the institutions that are created under a decentralised system should be purposefully linked to the overall objective of decentralisation. Giving a historical context of Uganda's decentralisation, the thesis notes that institutional accommodation of ethnic diversity in a decentralised system, particularly so in a multiethnic state, is a vital peace building measure. It is argued the exclusion of ethnicity in Uganda's decentralisation is premised on unjustified fear that ethnicity is potentially a volatile attribute for countries immerging from conflict. It maintains that the unilateral creation of many districts, the adoption of a winner-takes-all electoral system, the absence of special seats for ethnic minorities as well as the vaguely defined district powers and functions do not serve the overall objective of decentralisation. The thesis also finds that district councils are overregulated, with little respect for their autonomy, a phenomenon that is highly nostalgic of a highly centralised state. The thesis therefore calls for immediate reforms of Uganda's decentralisation programme.

▼ This dissertation examines the
principle of subsidiarity as articulated within the body of
Catholic social thought, and explores its validity within the
governance structure of the Catholic church. Special attention is
given to the status and role of the laity, and the implications of
subsidiarity with regard to lay authority and decision-making in
the church. Chapter One outlines some problems with ecclesial
governance today, discusses the current status and role of the
laity, and proposes an application of subsidiarity in the church.
Chapter Two provides an overview of how the laity has been
understood throughout church history to the present day. This
chapter also examines alternative understandings of the laity's
nature and place in the church, offered by liberation and feminist
theologians, and in response to the priest sexual abuse scandal
uncovered in the United States. Chapter Three attends to questions
of ecclesiology and authority. The author argues that an
examination of the nature of both magisterial and lay authority
reveal expanded opportunities for laypersons to exercise
substantial authority within the church, the theological
foundations of which are grounded in a communio ecclesiology and
the sensus fidei. Chapter Four provides a history and development
of subsidiarity in the Catholic tradition, including a summary of
the arguments at the magisterial level both supporting and
contesting the validity of the principle's application in the
church. The author asserts that, based on an ecclesiology of
communio and a renewed understanding of magisterial and lay
authority, subsidiarity is a valid principle with regard to
ecclesialgovernance, allowing for laypersons to exercise a
substantial role in decision-making in the church. The final
chapter places subsidiarity in relationship with the principles of
justice, human dignity, the common good, and solidarity; suggests
concrete practices that the church might adopt in order to reflect
subsidiarity in ecclesial governance; and discusses implications

▼ Australia’s federal system of government is established by the structure of the Constitution which provides for a central federal government and six state governments. When the Constitution was originally drafted, the framers sought to make the states central players in the new federation, on an equal footing with the new Commonwealth government. This is evident from the Convention Debates, from federal theory itself, and from the manner in which the early High Court of Australia interpreted the Constitution. However, in the Amalgamated Society of Engineers v Adelaide Steamship Co Ltd (‘Engineers’), the High Court broke with this tradition of originalist interpretation by utilising a method of constitutional interpretation (literalism) which favoured centralisation of power, and thus compromised the federal balance.This trend toward centralisation continued and is evident in more recent decisions. These include New South Wales v Commonwealth of Australia (‘Work Choices’ case), where a majority of the High Court affirmed that the federal balance is not relevant when interpreting the Constitution and Ha v New South Wales (‘Ha’), which affirmed a broad interpretation of excise duties resulting in a loss of $5 billion per annum to the states. This thesis will evaluate whether aspects of the principle of subsidiarity can be implemented by way of constitutional amendment and legislative and procedural reforms, to restore the federal balance. The principle of subsidiarity has its origins in Catholic social theory and has been incorporated into European Union law in art 5(3) of the Treaty on European Union (‘TEU’). The principle guards against centralisation by providing that governance should be undertaken at a local or community level, as opposed to a central level, wherever possible.

▼ Cette étude a pour but d’essayer de comprendre les nouvelles formes de régulation sociale qui consiste à évacuer la conflictualité au profit d’une tentative de normalisation du champ politique par la cybernétique. Pour ce faire, notre travail développe un modèle théorique qui croise la théorie du management comme tentative de neutralisation du politique avec ses nouvelles formes d’expression appelées « Gouvernance ». Les techniques managériales contemporaines sont la mise en œuvre de présupposés théoriques élaborés dans l’immédiat après-guerre avec la naissance de la cybernétique. Ce nouveau paradigme fait que le politique est désormais cantonné à la recherche de l’efficacité et de la performance. Toutefois, cette prétendue neutralisation opérationnelle et la culture du résultat qui lui est associé se révèle être une manière de décrédibiliser le nécessaire affrontement idéologique qui est le cœur battant de la vie démocratique. C’est ainsi que l’on peut observer depuis quelques années déjà, les signes d’une fragilisation du monde démocratique. La hausse de l’abstention, l’installation d’un puissant vote protestataire et la crise des partis de gouvernement en sont les signes les plus remarquables. A des degrés divers, la défiance à l’égard des institutions et des acteurs politiques est commune à la plupart des démocraties, y compris là où le régime démocratique semblait le plus solidement enraciné. Dès lors, on ne peut plus penser le politique selon une norme unique, propre à l’Occidentalisation du monde. Que la conflictualité sociale traduise un désaccord profond entre le pouvoir qui est devenu totalement étranger à la vie réelle et la puissance populaire qui ne se reconnaît plus dans ses élites, rend d’autant plus pertinente une approche centrée sur la cybernétique.
This study aims to understand the new forms of social regulation that, in hampering any forms of conflictuality, tend to the normalization of the political field through cybernetics. In this respect, our dissertation develops a theoretical template at the crossroads of management theory as an attempt to neutralize politics and new forms of expression called « Governance ». Contemporary managerial techniques are the implementation of theoretical assumptions developed in the immediate post-war period with the birth of cybernetics. This new paradigm means that policy is now limited to the pursuit of efficiency and performance. However, this de-ideologisation and the culture of the results prove to be a discredit of the necessary ideolological confrontation which is at the very heart of the democratic life. This is why many signs of the weakening of democracy are to be seen in the recent years. The rise of abstention, an enduring populist vote and the crisis of the governmental parties are the most obvious ones. To different degrees, the distrust of the political institutions and actors is shared by all the democracies, even by those where the democratic system seemed to be very firmly rooted. ▼ The American political tradition is steeped in localism. Arguments on behalf of the local and local government are ubiquitous in American history. Here, I provide an analysis, description, and critique of the “tradition of localism” in American political culture with an analytical introduction, three case studies, and a normative conclusion. The existing literature on localism is mired in conceptual confusion. Therefore, I first clarify the concept of localism. Localism is actually an umbrella concept covering three sub-concepts: localism as attachment (social), localism as activity (political), and localism as theory (ideological). Two insights from political geography further clarify localism as activity: (1) “the local” is relative and (2) conceptualizations of space are political. Localism as activity is defined as attempts to alter the hierarchy of governmental scale by transferring political authority from higher to lower-level governments. In chapter 2, I show that the American Anti-Federalists’ localism is held together by two spatial theses: (1) attachment to government is negatively correlated with geographical distance, and (2) diversity is positively correlated with territorial size. My interpretation improves on the existing literature by providing a unified account of the Anti-Federalists’ spatio-political commitments. In chapter 3, I show how popular sovereignty in the antebellum era, as advanced by Stephen A. Douglas, is best understood as an example of localism as activity rather than an offshoot of the ideal of popular sovereignty in the western political tradition. I also show that the debate over slavery in the territories is usefully understood as a conflict in the politics of space over how to define “the people.” In chapter 4, I show how the ideology of local control, as a form of localism as theory, played a causal role in the demise of school desegregation beginning in the 1970s. The Supreme Court and the American public treated the benefits of local control and neighborhood schools as considerations to be weighed against desegregation. I conclude by critiquing the principle of subsidiarity—a principle that captures the implicit normative claims of the localist tradition in the United States.

Ainsi faut-il souligner que l’environnement dans lequel a pu éclore la théorie de la subsidiarité aura pu, entre autres, influencer le principe inscrit en droit de l’Union européenne. Dès leurs origines, il appert que de profondes divergences imprègnent le binôme subsidiarité/souveraineté. Divergences d’abord, de théories qui éloignent et marquent profondément les deux concepts étudiés ; divergences ensuite, de logiques qui sont insufflées de part et d’autre au sein de la construction européenne. Ces contradictions mises à jour, il devient possible de trouver des zones de convergences entre ces deux pôles conceptuels. Convergences d’abord, qui font la promotion de la figure et de la sphère de l’Etat par la réintroduction et la réapparition de la souveraineté étatique ; convergences ensuite, qui déterminent les frontières – malléables – des pouvoirs à l’intérieur desquelles chaque échelon conduit et développe ses propres sphères de compétences
At first sight, subsidiarity would be opposed to sovereignty. If the relevant words and the concept meaning make sense, they have also a history. So we must emphasize that the environment in which appeared the theory of the subsidiarity might have influence, among others, the principle of subsidiarity such as registered in the European Union law. Since their origins, profound differences appear which imbued the subsidiarity/sovereignty combination. First, different theories putting at a distance and deeply impressing the two concepts discussed. Then divergences, which are infused logic from both sides within the European construction. These contradictions updated, it becomes possible to find areas of convergences between these two concept poles. Convergences initially, which promote the figure and the sphere of the State by the reintroduction and the reappearance of the official sovereignty; then convergences, which determine the frontiers – pliables ones – powers inside which each level leads and develops its own spheres of competence

▼ A presente tese tem como escopo principal delimitar a competência regulatória que incide sobre setor bancário. O tema desperta interesse em face da estrutura do Estado brasileiro a qual apresenta dois tipos de regulação: a geral e a setorial. E esta composição gera, dentro do setor bancário, um aparente conflito entre os órgãos encarregados de exercerem a regulação geral e o Banco Central do Brasil, titular do poder regulatório setorial. Diante deste cenário, o trabalho se inicia com a descrição da nova teoria de regulação e seus desdobramentos dentro do setor bancário, com a exposição dos riscos e dos instrumentos específicos da atividade financeira. Após, uma análise sobre o Princípio da subsidiariedade, o qual sempre foi utilizado como mecanismo de delimitação de competências. Em seguida, um estudo sobre o Sistema Financeiro Nacional e as matérias de regulação geral dentro do ordenamento pátrio, a saber: defesa da concorrência e defesa do consumidor. Por fim, serão demonstradas quais competências são inerentes às atividades do Banco Central do Brasil e quando surgem as competências dos órgãos encarregados de aplicarem as matérias de regulação geral, sendo utilizado como elemento delimitador o Princípio da subsidiariedade.
This thesis has as its principal aim at defining the regulatory competence that focuses on the banking sector. The issue arouses interest in the face of the structure of the Brazilian State, which has two types of regulation: the general and the sector ones. And this composition generates, within the banking industry, an apparent conflict among the bodies responsible for exercising general regulations and the Central Bank of Brazil, holder of the regulatory sector power. In this scenario, the work begins with a description of the new theory of regulation and its consequences within the banking industry, with exposure risk and specific instruments of financial activity. Later, an analysis on the principle of subsidiarity, which was always used as a mechanism of division of powers. Then, a study on the national financial system and general regulatory matters within the homeland planning, namely: competition policy and consumer protection. Finally, we will demonstrate what skills are inherent to the activities of the Central Bank of Brazil and where the responsibilities of the agencies charged with applying the general regulatory matters, using the principle of subsidiarity as enclosing element.

▼ Diante do atual estágio de desenvolvimento do Processo Civil e da necessidade de se conferir aplicação da garantia constitucional da duração razoável do processo, os artigos 769 e 889 da CLT que tratam sobre a aplicação subsidiária do Direito Comum ao Processo do Trabalho, comportam interpretação conforme a Constituição Federal e principalmente diante dos princípios, permitindo a aplicação de normas processuais mais adequadas à efetivação do Direito. Assim sendo, o presente trabalho analisa a aplicação subsidiária de normas do Processo Comum ao Processo do Trabalho, mormente no que tange as recentes inovações trazidas pelas Leis 11.232/2005 e 11.280/2006, tendo como parâmetro a principiologia específica do Direito do Trabalho, bem como a valorização do trabalho humano. A abordagem faz-se de extrema necessidade e valia, principalmente na análise de omissões ontológicas e axiológicas, bem como na admissibilidade e aplicação dos princípios da Instrumentalidade, Celeridade, Efetividade, Proteção e Não-retrocesso social.
In today s stage of development of Civil Procedure and the need to check the applicability of the constitutional guarantee of a reasonable duration of proceedings, the articles 769 and 889 of the Labor Code, which provides for the subsidiary application of the Common Law Procedure of Work, include interpretation as the Federal Constitution and especially on the principles, allowing the application of procedural rules more suited to the realization of the law. Therefore, this work is to examine the scope of application as rules of procedure common to the labor process, especially concerning the recent innovations introduced by Law 11232/2005 and 11280/2006, limited to specific set of principles of labor law and the enhancement of human work. The approach it is most needed and valuable, especially in dealing with ontological and axiological omissions, as well as eligibility and application of the Instrumentality, Speed, Effectiveness, Protection and Non-social regression.

▼ The dissertation analyzes the subsidiarity
principle as one of the key methods of social performance of modern
jurisprudence, protection of human rights, social harmony, state
governance and self-government. The dissertation presents the
evolution of the concept of subsidiarity, analysis of the meanings
of its use to enable the understanding of subsidiarity as an
ethical and social value, which is important in shaping the value
orientations, in further development of the social state, improving
the efficiency of institutional system management, protection of
individual rights and their effective implementation in the state
organization. The dissertation analyzed the European Union
legislation and documents of institutions important for the
understanding of the concept of subsidiarity and its practical
application, by demonstrating how through the application of this
principle the competences of the institutions of the European Union
and national authorities are identified and, based on the principle
of decision making in the lowest link of the management chain
(closest to the citizens) the state distributes authorisations for
the institutions of the different management level (national,
regional or local). The dissertation presents the analysis of
national legislation which imposes the principle of subsidiarity,
discussed the impact of the principle on the system of legal
institutes, its use in the state governance and local

Disertacijoje yra analizuojamas subsidiarumo
principas kaip vienas pagrindinių šiuolaikinės jurisprudencijos,
žmogaus teisių apsaugos, socialinio sugyvenimo, valstybės valdymo
ir savivaldos socialinio veiksmingumo metodų. Disertacijoje
pateikiama subsidiarumo sampratos raida, jo vartojimo reikšmių
analizė, leidžianti subsidiarumą suvokti kaip etinę ir socialinę
vertybę, kuri yra svarbi formuojant vertybines nuostatas, toliau
plėtojant socialinę teisinę valstybę, didinant institucinių sistemų
valdymo efektyvumą, asmens teisių saugos ir jų įgyvendinimo
veiksmingumą valstybės organizacijoje. Disertacijoje aptariami
teoriniam subsidiarumo principo sampratos suvokimui ir jo
praktiniam taikymui svarbūs Europos Sąjungos teisės aktai ir
institucijų dokumentai, parodoma kaip jį taikant identifikuojamos
Europos Sąjungos ir valstybių narių institucijų kompetencijos bei,
vadovaujantis sprendimų priėmimo žemiausioje valdymo grandyje
(arčiausiai piliečių) principu, valstybėje paskirstomi įgaliojimai
skirtingo (valstybinio, regioninio ar vietos) valdymo lygmens
institucijoms. Disertacijoje pateikiama nacionalinės teisės aktų,
įtvirtinančių subsidiarumo principą, analizė, aptariamas šio
principo poveikis teisinių institutų sistemai, jo panaudojimas
valstybės valdymui ir vietos savivaldai, apibūdinama subsidiarumo
principo paskirtis valdžios institucijų sąrangoje, nustatant ir
atribojant institucines galias, parlamentinės ir administracinės

▼ The theoretical framework within which lies the object of this thesis is that of the sciences of organization and function of the state. In particular, the main focus of the thesis is on the development and formulation of the political and social teaching of the Catholic Church, as well as the effect that this had on shaping public (state) power, policy and administration. More specific issues are the development of a theory of the state, the distinction between state and society, the relations of economic and political power, the establishment and purpose of political society, the scope and limitations of the powers of political power, the designation or undermining of certain public policies, the criticism of the democratic system, the empowerment of civil society and its relations to state power, the fundamental principle of the “common good”, the formulation of the principles of “solidarity” and “subsidiarity”, as well as the contribution to the development and organization of the international community. So far the main focus of the relevant research has been on the study of the development of theories of politics by prominent authors such as Augustine or Thomas Aquinas, on the causes and effects on investiture (de investiture) struggle or in specialized cases, the formulation of political-administrative views through specula principum of the medieval, primarily Christian, mirrors of the rulers. A key feature of this trend was to place emphasis much more to the regimen regale (the royal governance) and its relationship to the regimen animarum (governance of souls) and less on the regimen politicum, the political governance, which constitutes the focus of the research conducted under the submitted doctoral thesis. The thesis is divided into two parts. The first is divided into two sub-chapters, the first of which refers to the historical prolegomena and includes the historical evolution and formulation of the historical context, starting with the early opinions of the Church regarding power and state constitution. Next follows the study of eminent thinkers who have decisively influenced the relevant area, such as Augustine, Gregory I the Great, Gregory VII, Innocent III and Thomas Aquinas. The second chapter of the first part approaches the crossing of views on the state that were shaped within the above historical context with the newer world. Within this framework the issues examined are the idea of resistance to the authority of the Church, the theory of Synodism (conciliarismus), the effects of Reformation and Counter-Reformation. It also approaches the development of the relevant views of the Church in the light of Enlightenment and the French Revolution and the period of the 19th century and the political conditions for the development of social teaching are specifically analyzed. ▼ After World War II, in order to restore her international position, Germany participated in European economic integration and Ostpolitik. After the reunification of Germany and the establishment of EU, which represented that the country reinstated and obtained her legal authority with full national sovereignty, Germany has been supportive of the integration of politics and economics of EU in the 1990s. For instance, Germany has been endeavoring to led the development of EU toward a federal system, and helped issue a single currency for European Union, euro. After the 2009 euro debt crisis, due to her deepening EU economic mechanism, stabilizing euro became the top priority of Germany. Furthermore, Germany has been insisting that the strategies responding to the crisis should be kept to promote the federalization the system of EU.
When facing the continuing euro crisis, Germany took the lead in response to the crisis via suggesting economic and financial strategies such as âStability and Growth Pactâ, â Fiscal Compactâ and âAusterity,â and measures that were aimed at the improvement of competitiveness in EU. By executing the above methods, Germany and EU could go deeper into those indebted countries than applying the âPrinciple of Subsidiarityâ which enhanced the power of EU and Germany beyond the original division of the authority between the member states and EU. The author attempts to analyze how Germany has maintained her national interests by employing the strategies of bilateral and multilateral cooperation in the perspective of âfederalism.â

▼ La précision des critères d’application du principe de subsidiarité et le développement de son contrôle par les institutions politiques constituent un progrès vers un plus grand respect de ce principe ; ces avancées restent néanmoins insuffisantes à en prévenir toute violation. En droit canadien, le problème est similaire, la précision des critères de la clause Paix, Ordre et Bon Gouvernement et de la clause de commerce, si utile qu’elle soit, ne permet pas d’éviter tout conflit de loi. L’étude de la jurisprudence de la Cour de Justice montre ses réticences à procéder à un contrôle allant au-delà de la recherche d’une motivation formelle de la nécessité de l’intervention européenne. Pourtant, la comparaison de la capacité à agir des différents niveaux de gouvernements, capacité à agir évoluant dans le temps, ne peut se faire sans référence au contexte d’application de la norme. La Cour de Justice pourrait comme la Cour Suprême du Canada, expliciter dans ses décisions son appréciation de la capacité à agir de chaque niveau de gouvernement. La subsidiarité éclaire sous un jour nouveau la clause de commerce ou la doctrine de l’intérêt national, jusqu’alors parfois perçues comme permettant un développement constant et unilatéral des compétences fédérales au détriment de celles des provinces. L’efficacité du contrôle du principe de subsidiarité ne dépend pas seulement de la Cour qui le met en œuvre mais peut aussi dépendre des institutions politiques l’ayant saisi, de l’argumentation des requérants en particuliers.

▼ Dans le contexte de la mondialisation contemporaine, le développement d’une
structure de gouvernance à plusieurs niveaux nous oblige à revoir notre compréhension de
la souveraineté de l’État et de l’exercice de la démocratie. Notre objectif consiste à
présenter la pensée de David Held au sujet des conséquences de ces transformations de la
gouvernance politique sur la théorie démocratique. Dans un premier temps, nous
analyserons les conséquences de l’atténuation de la souveraineté de l’État, dorénavant partagée avec diverses organisations supranationales, sur la théorie de l’État démocratique
moderne. Nous verrons comment Held répond au déficit démocratique constaté au sein de
ces organisations, en adaptant le principe de subsidiarité au système de gouvernance
multicouche émergeant, et ce, afin de rétablir la congruence entre les décideurs et les destinataires de leurs décisions, caractéristique de l’activité (libérale) démocratique. Dans un deuxième temps, nous présenterons les fondements normatifs du modèle théorique qu’il préconise pour assurer la démocratisation de ce nouveau système de gouvernance. Nous verrons pourquoi, selon Held, la poursuite de l’idéal démocratique exige aujourd’hui la
mise en oeuvre d’une variété de droits, inspirés des valeurs sociales-démocrates, qu’il faut enchâsser dans le cadre constitutionnel de toutes les institutions de gouvernance du monde contemporain. De plus, nous dégagerons les objectifs institutionnels qu’il faut atteindre afin
de parvenir à la réalisation d’une social-démocratie mondiale. Nous conclurons avec une
brève analyse critique de son interprétation du principe de subsidiarité et de son approche “du haut vers le bas” (top-down) des processus conduisant à la démocratisation des institutions supranationales.

▼ Le principe de subsidiarité, en droit de la Convention européenne, est un principe empreint d’ambiguïtés. D’origine prétorienne, il ne fait l’objet d’aucune définition formelle dans les textes ou la jurisprudence afférente et se voit ainsi marqué d’une indétermination sémantique et juridique certaine. Doté d’une double dimension à la fois procédurale et matérielle, il n’en reste pas moins un principe fondamental du droit européen, un principe qui structure, d’une part, l’organisation et le fonctionnement même du système et guide, d’autre part, l’interprétation et le contrôle du juge de Strasbourg. Parce que naturellement ambigu mais néanmoins directeur du droit européen, le principe de subsidiarité se présente donc comme un principe souple et malléable, par conséquent, adaptable. L’analyse de sa mise en oeuvre dans la jurisprudence européenne met ainsi en exergue l’inconstance et la variabilité d’application du principe, à la libre disposition du juge strasbourgeois. Mais analysée à la lumière du contexte actuel d’un engorgement sans précédent du système et donc d’une réaffirmation urgente de son caractère subsidiaire, l’utilisation fluctuante du principe s’apprécie sous un jour nouveau, visant à faire de la subsidiarité un principe non plus garant des libertés nationales mais désormais source d’un encadrement de celles-ci. Parce que moteur d’une responsabilisation accrue des Etats membres, le principe de subsidiarité apparaît donc comme une pièce maîtresse de la politique jurisprudentielle du juge européen.
As part of the European Convention, the principle of subsidiarity is marked by ambiguity. Originating from judges, it has not been formally defined in legal texts nor in any related jurisprudence and is therefore characterized by a semantic and legal indeterminacy. Featuring both a procedural and a tangible dimension, it remains a fundamental principle of European law. On the one hand, it structures, the system’s organization and operations. On the other hand, it guides the court of Strasbourg’s interpretation and review. Naturally ambiguous but still guiding European law, the principle of subsidiarity is presented as a flexible and malleable principle, and therefore adaptable. The analysis of its implementation in the European jurisprudence highlights its inconsistency and variability at the free disposal of the court of Strasbourg. However, in the light of the current context of an unprecedented saturation of the system and therefore of an urgent reassertion of its subsidiary nature, a fluctuating use of the principle is assessed differently to make it not a guarantee of national liberties, but a guide for them. As a driving force for increased accountability of member states, the principle of subsidiarity appears to be essential to the judicial policy of the European court.

▼ The European Union Fundamental Rights Agency, established in 2007, is a new institution in the EU legal and political framework and a new element in the engineering of fundamental rights protection at EU level. In “Leading by Example: a human rights agenda for the year 2000” – the agenda drafted by a comité des sages comprising Antonio Cassese, Catherine Lalumière, Peter Leuprecht and Mary Robinson – the institution of a monitoring agency focused on human rights was considered a fundamental element to trigger a more proactive and central role of EU institutions in the protection of human rights. Along with the EU Charter of Fundamental Rights and after the Lisbon Treaty entered into force, the Agency has increasingly covered a role in the constitutionalization process of the European Union and has been a new actor within the EU system of governance. Given its importance, we intend to clarify the evolution of this EU body, understand its connections with the EU institutions, analyze its activities, in order to assess its effectiveness in the protection of human rights and its potential in prompting more virtuous policy-making processes.

▼ This thesis takes as its point of departure the debate on federalism that emerged in Italy in the years preceding the unification of 1861 and that resumed in the early 1990s, a debate mainly revolving around the profound socio-economic differences between the North and the South of the country. Torn between continuous centripetal and centrifugal forces, but not characterized by ethnic connotations, the Italian regional model implemented with the 1948 constitution and strengthened in 2001 elicits questions that intersect with topical debates engaging scholars across the globe, and displays features that have the potential to stimulate fruitful discussions both inside and outside Italian borders. While the present state of Italian regionalism remains ambiguous, the Italian regional model distils lessons coming from different theoretical experiences, including federalism, sub-state nationalism, and the European unification process. Therefore, it can be seen as an innovative experiment crafted by those who were looking for a compromise between unitary and federal schemes. Adopting a theoretical framework combining literature on federalism, regionalism and sub-state national theory, this thesis addresses a number of questions that help fill a gap in scholarship. The thesis discusses the relationship between federalism and regionalism, arguing that regionalism is an overarching term that incorporates diverse experiences; consequently, the regional state paradigm to which Italy is usually associated is just one of the many shapes that regionalism can take. The research also identifies the elements enabling us to differentiate between a federal and a regional model, as well as the advantages of opting for a regional scheme (as opposed to a federal one). The socio-economic tensions between the North and the South of Italy offer the ideal basis to discuss non-national differences, an expression used to indicate political and socio-economic communities located within a geographical territory displaying some de facto asymmetries compared to the state-wide community, seeking some form of acknowledgement of their specificity. The thesis argues that national differences (e.g. differences based on linguistic, religious or other cultural issues) are not the only ones requiring attention, and it identifies a number of legal and constitutional stratagems that could be used to address non-national difference. Also, the recognition of non-national difference may also help find a solution to issues regarding sub-state national recognition. Finally, the thesis tries to find a point of reconciliation between federalism and solidarity, particularly in the context of non-national difference. The Italian regional experience serves once again as the point of departure to discuss whether federalism and solidarity are conflicting ideas, and to open a discussion regarding the exact contours of solidarity, especially in its horizontal understanding.

▼ This thesis explores subsidiarity's untapped potential as an enforceable legal principle in EU law. To date, discussion of the principle's function in European integration remains overly focused on its effect as a restraint on the Union legislature. In the first part of the thesis, I seek to challenge this entrenched view. Specifically, I question whether or not the subsidiarity principle could and, ultimately, should apply also as a brake on the interpretative authority of the Court of Justice. Arguing that subsidiarity does indeed have a role to play in this context, I then turn to examine, in the second part of the thesis, the implications of this conclusion for the Court's interpretation of the scope of the Treaty provisions guaranteeing intra-EU movement. In the final analysis, I argue that the subsidiarity principle necessitates an adjustment of the Court's current approach to defining the concept of an obstacle to intra-EU movement. This
adjustment isolates and protects an appropriate sphere of Member State regulatory competence from the Court's scrutiny at Union level. In so doing, it ensures that, in the process of establishing and managing a functioning internal market, Member States retain some space to breathe.

Докторска дисертација има за предмет анализу
развоја, природе, садржине, параметара и даље перспективе доктрине
поља слободне оцјене, превасходно кроз дескриптивно-аналитичко
истраживање праксе Европског суда за људска права (Суд). Основни
циљ овог истраживања је продубити разумијевање овог концепта, који
у српској међународноправној науци није на свеобухватан начин
обрађен. Поље слободне оцјене представља једну од најважнијих
доктрина тумачења у јуриспруденцији Суда. Државе уговорнице
Европске конвенције о људским правима (Конвенција) имају одређену
слободу у начину на који ће примјењивати обавезе из Конвенције. Ова
слобода се назива поље слободне оcjене (енг. margin of
appreciation). Полазиште овог истраживања је чињеница да су државе
уговорнице Конвенције изразито хетерогене и да је зато било
потребно успоставити sui generis систем заштите људских права који
би балансирао сувереност држава са њиховим обавезама према
Конвенцији. Суд је у том смислу у више наврата наглашавао да је
„машинерија упостављена Конвенцијом супсидијарна националним
системима за заштиту људских права“. Истраживање покушава да
смјести доктрину у контекст карактеристичних пракси тумачења Суда и
то из перспективе супростављености идеологија пасивног и активног
тумачења Конвенције. Начела аутономног, еволутивног и дјелотворног
тумачења Конвенције имају изузетно важну улогу приликом утврђивања
домашаја примјене доктрине. Поље слободне оцјене се посебно
разматра у случајевима који укључују сразмјерност ограничења
квалификованих права (чланови 8-11) као и у осталим случајевима
када се одмјерава важност права или оправдава њихово
ограничење.

▼ Within a public employment setting, both administrative and labour law jurisprudence continue to advance the fundamental rights and protections afforded to individuals by the Constitution under section 23 and 33. Although the Constitutional Court (arguably) seems to favour the determination of one right over another, there exists no legal basis – other than a policy basis – for such a direction. In the context of the employment of public officials, the Constitutional Court side-lined administrative law jurisprudence. The purpose of this dissertation is to explore whether public sector employees are still able to bring an application in a court of law under administrative law even when such is to be applied to quintessential labour cases. This dissertation has analysed the meaning of administrative action under section 33 and PAJA in Chapter 2 and, in Chapter 3, how the courts have approached administrative law within labour cases, uncovering important judicial arguments and direction. This leads to Chapter 4 where since Gcaba, case law and academic arguments have shown that the extent to which section 33 and PAJA apply to public-sector employment depends primarily on how one pleads.
The research methodology used in advancing these objectives has comprised solely of desktop literature review of case law, statute, various text books and academic journal articles. In the absence of legislative intention to deny public sector employees their right to administrative justice, it is shown that it is not uncommon for more than one constitutional right to apply to one set of facts. It is argued that three causes of action exist under PAJA, the LRA and legality and that these causes of action are still available to litigants, even though the court in Gcaba provided the general rule that administrative law no longer applies. The Constitutional Court’s explicit recognition on pleadings has resulted in lower courts providing protection to public sector employees by hearing matters pleaded under PAJA or the principle of legality as the chosen forum. A new direction of administrative law jurisprudence is being realised by lower courts in labour cases, which correctly balances the intention of the legislature and favourably adds to the notion that rights are cumulative and complimentary of each other. Chapter 5 concludes all the relevant literature as well as providing several recommendations. Although PAJA and legality are applicable, the LRA should be the first port of call. It would be beneficial for the Constitutional Court to re-look at this area of law with the aim of advancing fundamental rights.

▼ Cette thèse a pour objet d’évaluer les potentialités et les impacts des monnaies locales, sociales et complémentaires au regard des enjeux posés par le développement soutenable. La thèse adopte une approche socioéconomique et institutionnaliste, alimentée principalement par deux études de terrain sur les dispositifs du SOL Alpin (France) et de l’Accorderie (Québec) pour obtenir des données quantitatives et qualitatives. Dans une approche bioéconomique et socioéconomique, un double enchâssement de l’économie dans le social et du social dans l’environnement est postulé. À partir des résultats des enquêtes et de l’analyse théorique, un schéma monétaire à même de favoriser le développement local soutenable sera présenté. Cet agencement propose, dans un dépassement de l’approche en termes de complémentarité, de poser les jalons d’une perspective relative à la subsidiarité monétaire c'est-à-dire un agencement monétaire relatif à chaque niveau d’action sur le territoire.
This thesis aims to assess the potential and impact of local, community and complementary currencies with regard to the challenges posed by sustainable development. The thesis adopts a socio-economic and institutionalist approach based mainly on the SOL Alpin (France) and the Accorderie (Quebec) to obtain quantitative and qualitative data. In a bio-economic and socio-economic approach is postulated a double embeddedness of the economy in the social and social in the environment. From the survey results and theoretical analysis will be presented a monetary scheme able to support local sustainable development. This arrangement provides beyond the approach to complementarity, to lay groundwork for a perspective on subsidiarity money that is to say monetary arrangement on each level of action in the territory.

▼ Attraverso lo studio della disciplina giuridica dell’ente parrocchia nella sua evoluzione storica, dapprima sono stati enucleati i principi sottesi alla legislazione di riferimento, canonica statuale e concordataria, e, poi, sono state analizzate le loro diverse concretizzazioni a livello normativo.
Si tratta del principio gerarchico, di quello comunitario e di partecipazione, del principio di sussidiarietà, del principio di collaborazione e del principio territoriale, analizzati nei rapporti istituzionali tra la parrocchia e la diocesi, nei rapporti interni alla comunità parrocchiale, nelle relazioni tra istituzioni ecclesiastiche ed istituzioni civili. Si è evidenziato come l’ufficio ecclesiale del parroco, pur ancora gerarchicamente subordinato all’Ordinario diocesano, non sia più di natura vicariale; come ci sia stata una crescente valorizzazione del principio di partecipazione e dei profili di corresponsabilità di tutti i fedeli nell’edificazione della Chiesa, come Stato e Chiesa, abbandonando la reciproca diffidenza, abbia rinnovato l’impegno alla fattiva collaborazione per il benessere sociale, con un’adeguata attenzione da parte di entrambi alle esigenze del territorio.
Through the study of the rules I have specified the most important principles of the parish, territorial subdivision of the diocese recognized by the State. ▼ L’Étude porte sur un principe prétorien érigé par le Conseil d’État au travers de ses décisions et des conclusions rendues sous ses décisions par les Rapporteurs Publics. Depuis 1975 le Conseil d’État exerce le contrôle de la compatibilité d'un acte d'imposition vis-à-vis de conventions fiscales contre la double imposition et l'évasion fiscale qui est fait sous l'égide du principe de subsidiarité. En vertu de ce principe, au préalable du contrôle de «conventionnalité» de l'acte d'imposition, les juridictions doivent impérativement exercer un contrôle de la légalité de l'acte d'imposition, en prenant appui sur les seules dispositions du droit d'origine purement nationale, c'est-à-dire, du droit dit « domestique». Ce principe, tout juste nommé comme tel par le Conseil d’État dans une décision rendue en 2014, a longtemps fait l'unanimité au sein de la doctrine. Le principe de subsidiarité serait un principe conforme au bon sens et à la logique. Nous tentons au cours de ce travail de démontrer que le principe de subsidiarité des conventions fiscales pose problème à la fois d'un point de vue, strictement théorique, et à la fois d'un point de vue pratique. D'un point de vue théorique d'abord, il sera démontré que le principe de subsidiarité des conventions fiscales est particulier, il ne correspond à aucune autre application juridique de la subsidiarité, la similitude n'est que enveloppe terminologique. La version fiscale soulève un véritable problème théorique et pratique que la thèse tente de démontrer.
Our dissertation is about a praetorian principle erected by the French Administrative Supreme Court the Conseil d'Etat since 1975 and that became one of the major case law on international taxation under the French Law. From the given case law, it results that the checking of the conformity of a tax act issued by the French Tax authority with respect to a tax treaty, has to be made at a second stage, after of a domestic law based control by the judge. The principle implies the application of a method when controlling acts issued by the tax authority that tends to link the provisions of the tax treaty to be applied, of the prior qualifications provided by the domestic law. The principle has just been appointed as «the principle of subsidiarity of tax treaties, in a 2014 Decision, and differs from any other application of the subsidiarity theory in law.

► This essay studies the national parliaments' reasoned opinions at the early warning mechanism. The study aim to declare if there is any variation in which national parliaments who is active in the early warning mechanism, and if there is a variation in type of bills in the early warning mechanism. These study also wants to describe some variation in how the national parliaments argued in the reasoned opinions. The study gives an enhanced understanding of the importance and legitimacy of the early warning mechanism and the reasoned opinions. The result shows that there is a certain group of parliaments who are more active and these are with few exceptions EU 15 countries. The study also shows that there is some kind of bills that is more prevalent than others, there is however some variation. There is also a wide variation in the arguments raised in the reasoned opinions. The results indicate that the national parliaments varies greatly in managing the reasoned opinions and it gives a negatively impacton the early warning mechanism.
