dalis, taikoma savitai asmenų grupei. Tai silpnoji visuomenės narių
grupė, dėl nesubrendimo ir pažeidžiamumo reikalaujanti kitų
pagalbos savo teisių užtikrinimui. Darbe aptariamas vaiko teisinis
statusas, subjektiškumo ribos. Remiantis tarptautiniais teisės
aktais bei tarptautine praktika, analizuojamos vaikystės pradžios
ir pabaigos nustatymo problemos. Darbo pagrindą sudaro išsami kelių
fundamentalių vaiko teisių analizė. Visų pirma, analizuojama teisė
išsaugoti savo identiškumą, ypač atkreipiant dėmesį į įvaikinto
vaiko galimybę įgyvendinti šią teisę. Įvaikio teisė žinoti savo
biologinius tėvus nėra leidžiama daugelio valstybių praktikoje, o
tai sukelia teisės išsaugoti savo šeimos ryšius pažeidimą.
Atsižvelgiant į tai, kokia esminė tarptautiniu mastu laikoma šeima
vaiko auklėjime, analizuojamas teisinis šeimos statusas: teisės,
pareigos ir atsakomybės ribos auklėjant ir vystant vaiką.
Aptariamos skirtingos “šeimos” sampratos ir praktinė būtinybė,
siekiant geriausių vaiko intersų, šeimos santykius nustatyti pagal
faktines aplinkybes. Aktualus alternatyvių vaiko priežiūros formų
klausimas. Darbe dėmesys skiriamas įvaikinimo santykiams, ypatingai
atkreipiant dėmesį į tarpvalstybinių įvaikinimų aspektus. Vaiko
pilnaverčiam vystymuisi esminė yra apsauga nuo smurto. Darbe
analizuojamas ypatingai problematinis šios teisės aspektas –

Protection of the Rights of the Child:
Problems of Regulation on International Plane The rights of the
child constitute a part of fundamental human rights and are
applicable to a specific group of individuals. The immaturity and
vulnerability of these individuals requires interference of
international society to ensure and protect their rights. The final
paper views legal status of the child and the scope of child’s
capability. The problems of the beginning and the end of the
childhood are analised in accordance with international laws and
international practice. The final paper is based on the analysis of
several fundamental rights of the child. The paper includes the
right to protect identity with a specific reference to the rights
of adopted child. The right of the adpotee to know his/her
biological parents is not guaranteed by legal systems of many
states and this lacuna leads to the infringement of the right to
preserve family relations. Regarding the importance of the family
in child’s upbringing, the legal status of the family is analised,
including rights, duties and the responsibilities of the family
while educating and developing the child. The paper reviews the
different concepts of ‘family’ and highlights a practical necessity
to define the family accordingly to factual circumstances.

▼ The aim with this master thesis is to analyze a scientific material concerning the context between learning and child/student development, and factors which controls process of learning, to create an image with quality account and teaching in mathematics, which then can raise the mathematical knowledge among students. The phenomena which stand in focus for the investigation is: why there is a negative tendency for development of knowledge in mathematics, among the Swedish students that TIMSSs investigations showed in intercultural comparison within the years 1993, 1999, 2003 and 2007. The method is the ethnographical method, which is based on: analyzing scientific theories about learning child/student development, factors which controls process of learning, and factors which controls process of learning the most and qualitative empiric investigation with qualitatively analyzes the questionnaires, which is about factors which are controlling the process of learning and factors which are controlling the process of learning the most. Result of the theoretical and empiric analyzes shows that factors as school environment, attitude for subjects and teaching, controls and influence the learning. To end a unenthusiastic tendency as a negative development of mathematical knowledge among students that is shown in TIMSS investigation and to elevate the students' performance in mathematics, an elevated qualitative account and teaching in mathematics, by the factors named. Safe school environments as the intercultural meeting place, the teachers influence part to the students' subjects' attitude in mathematics and goal related grading criteria in teaching, is all required for e qualitative teaching in mathematics.

▼ This thesis examines the trope of the child in South African literature from the early years of apartheid to the contemporary moment. The chapters focus on some of the most established and prolific authors in South African literary history and roughly follow a chronological sequence: autobiographies by the exiled Drum writers (Es'kia Mphahlele and Bloke Modisane) in the early 1960s; Nadine Gordimer's writing during the apartheid era; confessional novels by Afrikaans-speaking authors (Mark Behr and Michiel Heyns) in the transitional decade; and J. M. Coetzee's late and post apartheid works. I argue that, while writing from diverse historical and political positions in relation to South Africa's literary culture, these authors are all in one way or another able to articulate their subjectivities-with their underlying ambiguities, contradictions, and negations-by imagining themselves as the child or/and through childhood. My analyses of the works under discussion attend to the subversive and transformative potential of, and the critical energies embedded in the trope of the child, by investigating narrative reconfigurations of temporality and space. Firstly, I will be looking at the ways in which the images, structures, and aesthetics making up the imaginings of the child disrupt a linear temporality and serve as critique of a teleological historiography of political emancipation and the liberation struggle. Secondly, I will pay attention to the spatial relations with which representations of the child are bound up: between the country and the city, black townships and white suburbs, the home and the street. By attending to specific transgressions and reorderings of these spatial relations, my reading also explores the ways in which spatial underpinnings and ideological boundaries of national identities are contested, negotiated, and restructured by forces of the transnational, the diasporic, and the global around the figure of the child.

▼ Cognizant of the fact that children are vulnerable and need protection, the United Nations Convention on Rights of the Child was enacted in 1989 to safeguard the welfare of children. This development spurred the child rights agenda in most countries across the globe, and Ghana was no exception. Indeed, Ghana set the pace by being the first country to ratify the Convention. Thereafter, the 1992 Constitution and the 1998 Children’s Act were promulgated, and these became the linchpins for the promotion of the well-being of children in Ghana. Almost three decades after this landmark Convention and its domestication, the research, using primary as well as secondary sources, makes an assessment of its implementation, particularly in the area of child trafficking. The study relies on data obtained qualitatively through purposive sampling of expert opinions, using semi-structured interviews. The county has come under international scrutiny in recent years due to the prevalence of the threat in Ghana. For this reason, the study focuses its lenses on Article 35 of the Convention as it pertains to child trafficking. It throws light on the fact that despite the adoption of the Convention, and the efforts made so far in its implementation, a lacuna exists between what is prescribed on paper and what is practiced. An examination is made of the policy, legal and institutional structures put in place to guarantee the realization of the UNCRC in Ghana. Cultural abuses, lack of awareness and strong institutions to serve as a deterrent, poverty, are among the factors that exacerbate the trafficking of children in Ghana. These children are trafficked into labour in key sectors of the economy such as mining and agriculture, and sometimes for sex. Despite the progress made in building partnerships, major challenges persist in other areas of the fight against trafficking such as prosecution of offenders and the protection of victims. It therefore behoves on Ghana, as the main stakeholder to put in place appropriate measures that will fulfill the stipulations of Article 35. The study therefore makes recommendations in this regard, in order that, the incidence of child trafficking will not only be significantly reduced in the short run, but ultimately eliminated in the long run.

asmuo, tačiau to nepakanka. Nors vaikas yra kiekvienos visuomenės
pagrindas bei ateitis, tačiau kartu jis yra kiekvienos visuomenės
silpnoji dalis, priklausoma nuo aplinkos, dažniausiai nesugebanti
apginti savo interesų, jo teises galima įgyvendinti tik per kitų
asmenų – visų pirma, tėvų, teises ir pareigas. Tačiau daugeliu
atvejų vaikų teisių ir teisėtų interesų pažeidimams atsirasti
sąlygas sudaro būtent suaugusiųjų asmenų, tarpusavyje nesutariančių
tėvų konfliktai. Vaikų, atsidūrusių tėvų konfliktų centre, padėtis
yra reikalinga apmąstymų. Oficiali civilinių bylų statistika
patvirtina, jog šiandien ginčų dėl vaikų gyvenamosios vietos
nustatymo sprendimas teismine tvarka itin aktualus. Šių ginčų gausa
įpareigoja valstybę bei visuomenę nebūti abejingais, kadangi
adekvatus šių ginčų teisinis reglamentavimas gali kokybiškai
užtikrinti vaiko teisių apsaugą. Darbe siekiama įvertinti, kaip
įgyvendinami geriausi vaiko interesai sprendžiant ginčus dėl vaikų
gyvenamosios vietos nustatymo, siekiama atskleisti šių ginčų
probleminius aspektus, pasiūlyti galimus jų sprendimo būdus.
Aptariamas teismo vaidmuo šio pobūdžio ginčuose, valstybinės vaiko
teisių apsaugos institucijos dalyvavimas, siekiama įvertinti šių
institucijų dalyvavimą geriausių vaiko interesų požiūriu.

Today a child is entitled with the same
rights enshrined in the provisions of the universal human rights
documents as an adult, but it is not enough. Though the child is
the foundation and the future of each society, at the same time it
is the weakest part of every society, dependent on the environment,
often unable to defend its interests; its rights can only be
realized through the other personsʼ, in particular, parental rights
and responsibilities. However, in many cases, the conditions for
infringement of the childrenʼs rights and legitimate interests
occur due to the conflicts arising between the adults, arguing
parents. The situation of children, who find themselves in the
centre of conflict of their parents, is to be considered properly.
The official statistics of the civil cases proves that today the
question of judicial judgment of the disputes on establishment of
the residence place of the child is of particular interest.
Multiplicity of such disputes obligates the state and society not
to be indifferent, because the adequate legal regulation of these
disputes can ensure the quality of protection of the childrenʼs
rights. Masterʼs thesis aims to access realization of the best
interests of the child in resolution of disputes regarding
establishment of the residence place of the child, to determine the
problematic aspects of these disputes, to offer possible solutions.

social change designed to motivate pediatricians to contact elected
officials to support ratification of the United Nations Convention
for the Rights of the
Child. The United States is the only country
in the world that has not ratified this treaty. Ratification by the
US could benefit American children, as well as children worldwide.
The intended audience for the campaign is pediatricians who are
members of the American Academy of Pediatrics (AAP).

▼ The United Nations Convention on the Rights of the Child was unanimously adopted in 1989. It was hoped that the Convention would have a positive impact on all children however, despite a country ratifying the Convention and proclaiming to have laws in the interests of children it is still possible for that country to fail in the attempt to implement children’s rights effectively. This can clearly be seen in Kurdistan, Iraq where implementation of children’s rights remains limited. With the continuing violence in Iraq, children’s rights have been somewhat neglected and as with many such situations children are the innocent victims. Ensuring and improving the rights of the next generation of Iraq is vitally important at a time when the country is going through important changes and re-generation. This thesis gives information on the historical background of the UNCRC and looks at its substantive provisions in detail, it then goes on to compare the implementation of children’s rights in Kurdistan and the UK. The thesis highlights methods of implementation in both countries and looks at ways in which some of the Convention’s articles are written into law. The thesis concludes with recommendations on how Kurdistan can move forward to achieve better implementation of children’s rights.

▼ The main objective of this study was to gain deeper understanding of the effect of electioneering process on tourist arrivals in Kenya. It is within public domain that tourism is an immense contributor to Kenya’s economy and it is touted to be the acme foreign exchange earner after agriculture and horticulture respectively. But of recent it has experienced a downward trend due to insecurity in the country following issuance of travel advisories by major tourist source markets. Specifically, the study analyzed the effect of election campaign period; voting pattern; andthe relationship of election results on tourist arrivals in Kenya. This study adopted a descriptive research design whereby it targeted travel agents, tour operators, Ministry of Tourism (MoT), hotel and allied workers, Kenya Association of Travel Agents (KATA); Kenya Association of Tour Operators (KATO); Kenya Tourism Board (KTB); and airline personnel. The study used 150 respondents as a sample size. A questionnaire was employed as a data collection instrument. The data collected was coded and analyzed with aid of Statistical Packages for Social Sciences (SPSS Version 23.0). The analysis revealed that majority of the respondents agreed that election campaigns affects movement of people within the country, voting pattern has no effect on movement of people within the country, it is risky to travel a few days before and after the general elections, and that voting and announcement of the results causes’ tension, and there is a likelihood of violence after the release of the results. From the findings of the study it was concluded that election campaign period and election results negatively influence tourist arrivals in Kenya. In addition voting pattern has no effect on tourist arrivals in Kenya.

▼ In this thesis I analyse and evaluate the treatment of children who come in contact with the judicial system in Vietnam with a focus on the implementation of the state party’s obligations under the Convention on the Rights of the Child (CRC), which Vietnam ratified in 1990. I explore to what extent Vietnam has implemented its obligations and consider what it should do further to fully comply with international juvenile justice standards. These questions are addressed with respect to each aspect of the juvenile justice system: the prevention of juvenile delinquency, the treatment of juvenile offenders and the protection of child victims and witnesses of crime.
An interdisciplinary, mixed method approach has been employed, including analysis of documents, statistical analysis, case studies and contextual analysis. Vietnamese law and its actual implementation in juvenile justice are considered through the analysis of international and national legal normative documents, statistics, reports, academic studies and court cases. The thesis includes recommendations based on a careful consideration of Vietnam’s obligations under international law, particularly Vietnam’s commitment to its obligations under the CRC.
Research findings indicate that Vietnam has approached international juvenile justice standards in a number of aspects, including the age of criminal responsibility and the recognition of most juvenile offenders’ rights. However, there are significant shortcomings in the definition of the child, national policies on juvenile delinquency prevention, the rights of child victims and witnesses of crimes, and inadequacies in law enforcement. The thesis finally provides practical recommendations for law reform and mechanisms for effective legal implementation.

▼ Although young people have been a focus in the research, a gap remains in
research. While society has enacted laws and regulations concerning youth, they have
very limited say as to issues pertaining to them. In this study, I gained entry into an
organization involved in helping Latino youth in a specific community and working
with them. This research focuses on the experiences that youth had while conducting
social and community advocacy efforts within the San Diego region. I conducted
photo-elicitation interviews with the young members of Manos Unidas. My findings
support the "New" sociology of childhood perspective and indicates that youth take a
genuine interest in issues affecting them, and will be part of the decision making
process, if granted the opportunity. The youth from the organization were active in
projects helping the community because they recognized the importance of their
contributions and realized what a profound impact they can have on others.
However, their involvement was limited to an extent in that adults helped direct the
young members and their roles in the organization. The youth found their
experiences rewarding to not only the community, but within themselves as well.
However, significant strides must still be taken to further expand research on youth,
while involving, and including them in the decision making
process.

struktūra – aktualumo neprarandanti tema. Biudžeto dėka valstybė
turi didelę galimybę sukoncentruoti savo rankose didžiulius
išteklius svarbiausioms ekonominėms ir socialinėms problemoms
spręsti, gali įtakoti valstybės piliečių gyvenimo kokybę.
Pastaraisiais metais pasaulį sukrėtusi ekonomikos krizė dar labiau
kelia susidomėjimą valstybės biudžetu. Demokratija sustiprino
gyventojų reikalavimą, kad vyriausybė būtų atskaitinga ir gerai
tvarkytųsi. Pastaraisiais dešimtmečiais biudžetinių sistemų
reformos vykdomos daugelyje šalių. Tokiu būdu skatinamas didesnis
fiskalinis skaidrumas, efektyvesnis finansų valdymas. Iškyla
probleminiai klausimai: kiek šių dienų valstybės biudžeto procesas
atitinka teikiamas tarptautinių organizacijų rekomendacijas bei
nustatytus reikalavimus? Ar įstatymuose įtvirtinti reikalavimai,
rekomendacijos biudžeto valdymui įtakoja efektyvesnį biudžeto
procesą? Kokios biudžeto valdymo problemos ir kaip jas paaiškinti?
Iškėlus probleminius klausimus, tyrimo tikslas yra išsiaiškinti
valstybės biudžeto proceso sampratą ir palyginti šių dienų Lietuvos
biudžeto procesą su Prancūzijos biudžeto procesu. Lyginamoji

Concept and structure of budget’s process of
the state is relevance lined theme. According to the budget the
state has a huge opportunity to concentrate the resources in its
hands to solve the most important social and economic problems also
has a huge influence for the quality of life of the citizens. The
global economic crisis, which has shaken the world in recent years,
raises further interest on the state’s budget. Democracy has
strengthened the demand of citizens, that government must be
accountable and works properly. A lot of states have been making
reforms of the systems of budgets in recent decades. By that way it
is activating the greater fiscal transparency and effective
financial management. Several problematical questions for the
research are rising up in that context: how much the particular
process of the current state’s budget conform the recommendations
provided by the international organizations and determined
requirements? Do the requirements determined in legislations and
recommendations for the management of the budget make influence for

▼ The child’s participation in any legal matter involving
him/her is crucial whether received directly or indirectly through
a legal representative. The significance of the child’s views in
legal matters is accepted internationally and is entrenched in
South African law. This is the main feature of the present
research. In Roman law the paterfamilias was the complete
antithesis of the best interest of the
child with his paternal
power entirely serving his own interests. The best interests of the
child progressively improved his/her participatory rights and the
dominance of paternal authority in Roman, Germanic, and Frankish
law eventually gave way to parental authority and assistance in
Roman-Dutch law. This advanced the child’s participation in legal
matters and under Roman-Dutch law, his/her right of participation
included legal representation by way of a curator ad litem. The
child’s best interests were consistently viewed from an adult’s
perspective and resulted in an adult-centred assessment of his/her
best interests. Statutory intervention increased the child’s
participatory and representation rights, however, the tenor of
these items of legislation remained parent-centred. The Appeal
Court later dispelled any uncertainty regarding the paramountcy
with respect to the best interests of the
child. During the 1970s
in South Africa, the emphasis began shifting from a parent-centred
to a
child-centred approach in litigation between parents in cases
involving their children. An open-ended list of factors comprising
the best interests of the
child accentuated this shift. Courts were
encouraged to apply the paramountcy rule in legal matters
concerning children and to consider the views of children in
determining their best interests. The new democratic constitutional
dispensation in South Africa, followed by the ratification of the
Convention on the Rights of the
Child and the African Charter,
obligated South Africa to align children’s rights with
international law and standards. The South African Law Reform
Commission set out to investigate and to formulate a single
comprehensive children’s statute. The resultant Children’s Act 38
of 2005 is the most important item of legislation for children in
private law in South Africa. The Children’s Act provides for the
widest possible form of
child participation in legal matters
involving the
child. It revolutionises
child participation
requiring no lower age limit as a determining factor when allowing
the
child, able to form a view, to express that view. The child’s
right to access a court and to be assisted in doing so further
enhances his/her participatory right. Effective legal
representation is the key in ensuring that children enjoy the
fundamental right of participation equal to that of adults in legal
matters involving children. Comparative research of
child laws in
Australia, Kenya, New Zealand and United Kingdom confirms that
South Africa is well on the way in enhancing children’s
participatory and legal representation rights in legal matters

▼ The child’s participation in any legal matter
involving him/her is crucial whether received directly or
indirectly through a legal representative. The significance of the
child’s views in legal matters is accepted internationally and is
entrenched in South African law. This is the main feature of the
present research. In Roman law the paterfamilias was the complete
antithesis of the best interest of the
child with his paternal
power entirely serving his own interests. The best interests of the
child progressively improved his/her participatory rights and the
dominance of paternal authority in Roman, Germanic, and Frankish
law eventually gave way to parental authority and assistance in
Roman-Dutch law. This advanced the child’s participation in legal
matters and under Roman-Dutch law, his/her right of participation
included legal representation by way of a curator ad litem. The
child’s best interests were consistently viewed from an adult’s
perspective and resulted in an adult-centred assessment of his/her
best interests. Statutory intervention increased the child’s
participatory and representation rights, however, the tenor of
these items of legislation remained parent-centred. The Appeal
Court later dispelled any uncertainty regarding the paramountcy
with respect to the best interests of the
child. During the 1970s
in South Africa, the emphasis began shifting from a parent-centred
to a
child-centred approach in litigation between parents in cases
involving their children. An open-ended list of factors comprising
the best interests of the
child accentuated this shift. Courts were
encouraged to apply the paramountcy rule in legal matters
concerning children and to consider the views of children in
determining their best interests. The new democratic constitutional
dispensation in South Africa, followed by the ratification of the
Convention on the Rights of the
Child and the African Charter,
obligated South Africa to align children’s rights with
international law and standards. The South African Law Reform
Commission set out to investigate and to formulate a single
comprehensive children’s statute. The resultant Children’s Act 38
of 2005 is the most important item of legislation for children in
private law in South Africa. The Children’s Act provides for the
widest possible form of
child participation in legal matters
involving the
child. It revolutionises
child participation
requiring no lower age limit as a determining factor when allowing
the
child, able to form a view, to express that view. The child’s
right to access a court and to be assisted in doing so further
enhances his/her participatory right. Effective legal
representation is the key in ensuring that children enjoy the
fundamental right of participation equal to that of adults in legal
matters involving children. Comparative research of
child laws in
Australia, Kenya, New Zealand and United Kingdom confirms that
South Africa is well on the way in enhancing children’s
participatory and legal representation rights in legal matters

▼ Denna studie belyser några svenska statliga myndigheters genomförande av FN:s konvention om barnets rättigheter. Ambitionen är att fördjupa förståelsen av och få ökad insikt om betydelsefulla förutsättningar vid ett implementeringsarbete sett ur ett systemteoretiskt perspektiv. Studien baseras på semistrukturerade intervjuer med myndighetsrepresentanter. Genom framställande av myndigheternas hierarkiska nivåer: ledarnivå, organisationsnivå och kontextnivå, skildras respektive nivås betydelse och medverkan under konkretiseringen av konventionen. Studien indikerar att en kombination av information, yttrande och förståelse mellan de olika nivåerna, är av central betydelse beträffande realiserande av Barnkonventionen.

U radu su izloţena teorijska razmatranja o
problematici motivisanja uĉenika za uĉenje i uĉešća u razliĉitim
nastavnim aktivnostima. U teorijskom okviru istraţivanja sloţenost
pojma motivacije za uĉenje predstavljena je kao prikaz ideja i
mišljenja razliĉitih autora. U savremenoj pedagoškoj literaturi
postoje razliĉiti pristupi i shvatanja teoretiĉara o motivaciji za
uĉenje. Razlike u shvatanjima prepoznaju se u pogledu definisanja
osnovnih pojmova, poput motivacije za uĉenje, motivacionih
uverenja, atribucija, ciljeva postignuća i drugo. Razlike se mogu
prepoznati i u pogledu naĉina merenja motivacije za uĉenje i u
pogledu metodoloških pristupa u prouĉavanju motivacije za uĉenje.

▼ Tanzania ratified the Convention on the Rights of the Child 1991, but still 32 per cent of the Tanzanian children estimate to be involved in child labour. Why children work, the work they most commonly do, and under the conditions which they work differ regionally. This study aims to find the underlying causes behind child labour among boys in Babati Town, both from the researcher’s - and the children’s own perspective. The study was accomplished through a qualitative case study in Babati Town and the data were gathered through semi-structured interviews, primarily with the child labourers’ themselves to get the right child perspective. The data from the interviews was analyzed according to four chosen theories of underlying causes behind child labor with the purpose to see to what extent the findings of the study correlate to the indicators outlined in each theory. The study found that indicators from each theory correlating with the Babati case with poverty as the major underlying cause behind the labouring. From the child labourer’s perspective was poverty the underlying cause for their labouring. Poverty on its own was though, from the researcher’s perspective, found to be insufficient to explain the prevalence of child labour. The problem of child labour is massive due mainly widespread poverty but also due the social context and its traditions, insufficient funding, school policies and inadequate implementing of important regulations as the Convention on the Rights of the Child.

▼ Despite extensive studies by urban theorists into the growth and development of cities, little within these accounts explains the role and influence of property development as a catalyst for such growth. The most recent accounts of property development in this context were made in the early 1990s by Healey, Gore and Nicholson, and such accounts not only focussed on a
process-based view but were made predominantly through the eyes of economists, political economists, planners and social theorists with few property developer protagonists.Looking through the eyes of the property developer, and assisted by the author’s related history as a builder and developer, a new model emerges which is based on: a theoretical analysis; three case studies of cityscapes in Australia- in Townsville, the Palmer and Railway Precincts (Queensland) and in Newcastle, the Honeysuckle Precinct (New South Wales); further case examples and auto-ethnographic reflection.A model is built which articulates the nature of constituent land parcels within cityscapes, the conditions for their transition and resultant creation of new developments, which impact on the growth of cityscapes. The mercurial and transient nature of the property developer and the mechanistic nature of property development are revealed, which goes beyond traditional
process-based views. Developer protagonists which are often seen to be the root cause of unwanted growth are revealed to be
subject to a greater mechanistic force that relies on alignments and windows of operation.A new and missing lens is provided to the existent body of research into the growth of cities through the eyes of the property developer which informs researchers, planners and policy- makers. The often high level, morphological view of planners and policy makers is balanced by a model which is built from the ground up, revealing the mechanism of property development and its key forces and protagonists.

▼ This paper aims at exploring the importance of the child hearing as a paramount mechanism for the child to exert its opinion and to delimitate the content of its superior interest.
The principle of the child hearing has a dual nature: the social hearing of the child and the judicial hearing of the child. Both sides in what regards this dual nature have great importance due to the fact that they contribute to shape the development of the child since its minority until becoming an adult. Therefore, we are prone to the implementation of the judicial child hearing in our judiciary system.
The scope of this thesis also serves to highlight the necessity of a profound analysis in what concerns the legal dimension of the “superior child interest” problem. Hence the importance of approaching the Portuguese and international legal landscape in order to understand how the different legal mechanisms articulate themselves with the goal of protecting the superior interest of the child. For instance, in Portugal there’s a panoply of procedures, such as injunctions and interim orders, with the supreme goal of assuring the protection of the “superior child interest”.
On that regard, the analysis of the Portuguese “Regime Geral do Processo Tutelar Cível”, enacted by the law No. 114/2015, September 8, is one of the main topics of this thesis. Its importance is justified by the fact that this legal regime not only regulates the subject of the judicial hearing of the child (direct regulation), but also regulates the procedures concerning the promotion and protection of endangered children and minors’ legal rights (regulated by remission).
Finally, this thesis approaches the questions that somehow are still connected to the social hearing of the child, even the ones that don’t relate to the legality of the child’s right to be heard.
A presente dissertação tem como escopo a reflexão sobre o princípio da audição da Criança, enquanto direito da Criança a exprimir a sua opinião e como mecanismo essencial na delimitação do seu superior interesse.
O princípio da audição da Criança, quanto à sua aplicação, concretiza-se numa dualidade: a audição social da Criança e a audição judicial da Criança. Quer a realidade social do princípio da audição da Criança, quer a sua efetivação no contexto judiciário assumem tremenda importância para o desenvolvimento integral da Criança até à fase adulta.
Uma melhor concretização do princípio da audição da Criança, na sua vertente judiciária, requer uma análise legal profunda dos preceitos (nacionais e internacionais) que sobre a matéria versam, seja no âmbito de providência tutelar cível, de situação de perigo para a Criança ou jovem, de prática de facto qualificado pela lei como crime por menor com idade compreendida entre os doze e os dezasseis anos, ou de processo de natureza penal.

▼ During the initial stages of Gestalt play therapy qualitative assessment is vital within the therapeutic relationship, to gain information about the
child in order to strengthen this relationship, enhance awareness and for further interventions.
Research confirmed the lack and problems with current assessment tools, within various helping professions, which were addressed in this study.
The board game, as a Gestalt assessment tool, was compiled for the primary school
child and focuses on the therapeutic relationship, sensory stimulation and the
process of the
child (Schoeman-3-aspect model). Information was gathered by a literature review, semi structured interviews with two professionals and by observing the application of the board game.
Valuable information was gathered concerning the
child and was strengthened by literature. Relevant conclusions and recommendations were made. This board game can be effectively used by play therapists in the initial stages of assessment with the primary school
child, for relationship building, sensory stimulation and determining the
child's
process.

▼ In Australian parenting disputes pursuant to the Family Law Act 1975 (Cth), an Independent Children’s Lawyer (ICL) may be appointed to represent the interests of the child the subject of the dispute. The role of the ICL has been formalised through legislative direction and the creation of national guidelines. Yet there are significant State and regional variations in how ICL work is conducted and differing understandings on the part of lawyers as to what the role requires.
Concerns have been expressed about the efficacy of ICLs and the quality of legal services they provide. These concerns are heightened by the relatively powerless position of children vis-à-vis the lawyer; continuing ambiguity about the status of children in family law disputes; the increased role ICLs are expected to play in gathering evidence and assisting the court; and an apparent increase in the proportion of matters in which an ICL is appointed, with associated implications for funding. Against this backdrop, the thesis examines the professional identity of ICLs, via analysis of interviews with 40 lawyers working in this capacity. Using this interview material, I assemble a model of how ICLs conceive of their role and what they consider to be effective practice.
I find that there is a disconnect between academic discourse, and the reality of ICL work and the place of the ICL in the family law system. Though born from, and sustained by, a set of essentially protective concerns, ICLs are now often described as a “voice” for children in the family law process and a means of enabling children’s rights to participation. This focus, however, disregards the “best interests” nature of the ICL role, the multitude of other tasks that ICLs perform, and the role they play in smoothing the operation of the family law system. Understanding the goals of the system, and the structural constraints affecting ICLs, is essential to any consideration of ‘effectiveness’.

▼ Since its inception in 1996, the institutional mother-child program has suffered from a lack of funding, increased restrictiveness in eligibility for participation, and in some cases has been cancelled entirely. Over the past two decades, the program has been criticized by its supporters for its lack of standardization and rigor and by its opponents because prison is seen as an inappropriate place to raise a child. Mother-child programming represents a highly controversial topic, dividing groups according to how they align themselves with the issues of women's rights, the rights of the child, and public safety concerns. This study explores the relationship between the social welfare and criminal justice systems and the various interpretative frameworks and logics used to govern the incarcerated mother under the program. Specifically, the analysis explores how local service providers at community-based agencies mediate state power and translate program objectives. Furthermore, rehabilitation programs are investigated to identify how incarcerated and formerly incarcerated women are framed in relation to the standard of the “best interests of the child” and the construct of community. Over a two-year period, in-depth interviews were conducted with CSC staff, child welfare, and local community-based organizations across four Canadian provinces and six municipal regions. Broader findings from this study suggest that despite its identification of women’s empowerment as its stated objective, the mother-child program is upheld by a set of logics that generate new modes of exclusion. Three main findings are revealed. First, the way that the community construct is idealized by state and local actors, as empowering and healing, is inconsistent with how criminalized mothers experience community in their day-to-day lives. Secondly, CSC and CPS differ in their interpretation of the “best interests of the child” standard and what that means for program applicants. The deployment of a community standard to assess children’s interest and to evaluate for risk produces tension within the partnership. Third, I uncover that precarious patchwork funding models enhance organizational reputability even though they detract from direct client service with incarcerated mothers, intensifying the exclusion of mothers and their children from accommodation and vital services.

Our questions were: “How is the child perspective perceived by the Social Services?” and “In what way is the child perspective put into practice in the Social Services’ work?” Our approach to knowledge is based on the hermeneutic tradition of knowledge. The essay rests upon semi-structured interviews with ten Social Services’ workers. We have analysed our results from the theory of actions where we have applied analytical ideas; the five P’s and actor and objective perspective. Our main findings in the study were; the Social Services’ workers regarded the child perspective as a complex and hard to define concept. Furthermore, the Social Services’ workers considered to think the fundamental apprehension of the child perspective; is children’s well-fare and protection from abuse. From which angle they choose to see the child perspective; the child’s, the parents or the professionals vary. The Social Services’ workers experienced the children were being implicated in the work. The reports are written from both angels, children and parents point of view. A special interest and importance from the Social Services’ workers were children being involved through-out the inquiry process as at decision-making. The child perspective doesn’t have to be crucial at a settlement. Based on our findings and our theory we can draw the conclusion that the scope the Social Services’ workers have in their work can influence how the child perspective is perceived and carried out and how it should be applied.

valstybės ekonominė sistema keičia vartotojų elgseną. Rinkos
ekonomikoje gausu įvairių gamintojų, kurie, tarpusavyje
konkuruodami, siekia patraukti vartotoją. Galimybė rinktis keičia
vartotojų elgseną. Tokioje situacijoje vartotojas kartais pats
nesuvokia, kodėl jis perka vienokias ar kitokias paslaugas. Tyrimo
problema: Kaip pažymi J. Stankevičienė (2004) vartotojų elgsena yra
dinamiškas sociokultūrinis reiškinys, todėl šios problemos
studijos, nepaisant atliktų tyrimų gausos, ne tik išlieka
aktualiomis, bet jų aktualumas tik didėja. Net ir tie tyrimai,
kurie atlikti išsivysčiusiose šalyse, dėl skirtingo sociokultūrinio
konteksto nedaug gali padėti suprasti analogiškų vartotojų elgseną
mažą gyvenimo rinkos sąlygomis patirtį turinčioje šalyje. Taigi
darbe formuluojama problema ir tikslas ištirti vartotojų elgseną,
yra reikšminga. Pastaraisiais metais pasirodė daugiau mokslinių
monografijų, straipsnių lietuvių kalba, nagrinėjančių vartotojų
elgsenos aspektus, tačiau tai vis dar aktuali teorinė ir praktinė

Relevance of the work. Basically the varied
state economical system changes the consumers’ behaviour. Within
the market economy dominate various manufacturers those being
competitive in regard of each other are seeking to attract a
consumer. An opportunity to choose changes consumer’s behaviour. In
such situation a consumer sometimes doesn’t realise why he
purchases items of some sort. Often his behaviour is influenced not
only with various environmental factors but also with his personal
assurances and values. The problem of the work. As certifies J.
Stankevičienė (2004) the consumers’ behaviour is the dynamic social
cultural appearance, therefore the studies of such problem
regardless an abundance of the accomplished researches remain not
only relevant but also their relevance is expanding gradually. Even
those researches which were accomplished within the developed
countries as concerns of social cultural context can little help
while understanding the behaviour of analogous consumers within the
countries having the diminutive life experience under the market
circumstances. Hence the problem and goal formatted at work are
important. In these latter years have appeared more scientific
monographs, articles in Lithuanian language analysing the aspects
of consumers’ behaviour, but this is still actual theoretical and

This paper analyzes the behavior of
athletics viewers the choice of a sporting event. In order to
attract more spectators to the track and field sports events, it is
necessary to analyze the behavior of the viewer to distinguish the
different groups with different interests needs. Object of work:
Athletics sports audience behavioral formation. Problem of
research: What are the factors most form the behavior of viewers
visiting the Athletics sports events? The purpose of work: to
reveal the factors shaping the behavior of spectators and and
develop model of athletic sports to attract viewers to increase.
Task of work: 1. Analyze internal and external factors of consumer
behavior and the consumer decision-making process. 2. Set in
athletics sports meeting key consumer issues. 3. The Athletics
factors influencing the behavior of spectators. 4. Develop a model
to attract viewers in athletics sport. The first part analyzes the
theoretical aspects of consumer behavior, consumer behavior defines
the concept, and the author analyzes the different consumer
behavior and decision-making models of consumer behavior
influencing internal and external factors. Athletics sporting event
consumers continue to be called at the audience. The second part
presented the research methodology, developed a questionnaire
tailored to the audience behavior Athletics sporting event in the
investigation. The third part describes the results of analysis.

▼ Theories of school-based consultation posit that by using consultative services to resolve a difficult problem, the consultee will gain the ability to solve similar problems in the future. This study sought to examine if exposing participants to the consultation
process results in increased understanding of the problem-solving
process as well as higher scores on a measure of problem-solving orientation. Participants (N = 207) were randomly assigned to watch a video of a consultant and consultee using the consultation
process to resolve a problem, a lecture style voice-over PowerPoint reviewing the steps of the problem-solving
process, or a video of two individuals discussing a problem with components of neither the consultative, nor the problem-solving
process included. The results of an omnibus F test revealed a statistically significant result across conditions on a measure of participants’ understanding of the problem-solving
process; however, post-hoc analyses were not statistically significant. No statistically significant effects were noted on a measure of problem-solving orientation. Implications of these findings are considered.

▼ Title: ”… Then came the realization that I was just like them. That I have a gambling addiction…” This is a qualitative study of four former gamblers and their experience of getting out of the gambling addiction. The study is about how individuals have overcome a gambling addiction. The purpose of this study is to examine the social processes and factors that are of importance when overcoming a gambling addiction. In addition, the study focuses on how individuals experience the change from gambling addiction to a life free of that addiction. In this thesis, I conducted a qualitative study in the form of semi-structured interviews with four former gamblers. The theoretical approach concentrated on Ebaugh’s (1988) role exit theory and Giddens’ (2005) identity formation theory has been used to illustrate the interviewees' experiences of gambling addiction and their identity as addiction free. The study shows that the gambling addiction has brought economic, social and health-related impacts and some of these aspects still exist today. The exit out of a gambling addiction has been a process with different phases and events where the process for some has been incrementally with relapses during the journey. Based on my results, the changing process appears to consist of parallel turning points where different and more significant events give rise to role exit. The study shows the need of continuous social support in combination with gambling association support efforts and the gamblers’ own insight, motivation and freedom of action. It appears that the interviewed have accepted their role that they had left behind and they take careful consideration to the past and the future and try to make more conscious choices and build their new identity. This is done by actions and re- evaluations of themselves and their world. It is based on their lives, by their own choices. However, these choices seem to be limited by conditions that occur in the interaction with the environment, social norms and social situations.

▼ Whilst policy formulation has been extensively studied and theorised in the literature, far less attention has been paid until fairly recently to the issue of policy implementation. For a long time it was more or less assumed that once policy was formulated, implementation was a relatively straightforward administrative matter. In the past twenty or thirty years, however, public administration scholars (such as Pressman and Wildavsky and, in the South African context, Brynard and de Coning) have devoted more attention to unravelling the complexities of policy implementation. The current study intends to apply these more theoretical approaches to an analysis of the implementation of the 1997 White Paper for Social Welfare with particular respect to children in conflict with the law, focusing specifically on the One Stop
Child Justice Centre in Mangaung, Bloemfontein. Welfare Service in South Africa before 1994 had a racial bias with services mostly unavailable to the majority of the citizens of the country. The 1997 White Paper for Social Welfare, based on a developmental approach to social welfare, was designed to take the country in a new and inclusive direction. In line with South Africa’s 1996 ratification of the UN Convention on the Rights of the
Child, as well as other international instruments, Section 4 of Chapter 8 of the White Paper focuses on crime prevention through development and restorative justice, and recommends diversion wherever possible in the case of juveniles. With respect to Juvenile justice, this section of the White Paper makes provision for the establishment of One Stop
Child Justice Centres, where a variety of services, from Social Development, the Department of Justice, the South African Police Services, Correctional Services, and the NPA, would be available to clients under one roof. All of these role players, it was envisaged, would operate as a multi-disciplinary team to achieve the objectives of the White Paper with respect to developmental and restorative forms of justice. The Centre at Mangaung is one of only a few centres to have been established as yet in South Africa. Although focusing in particular on the implementation of the 1997 White Paper, the study is also informed by other policy and legislative measures with respect to juvenile justice, in particular the
Child Justice Bill of 2002 (now the
Child Justice Act of 2008) and the Probation Services Amendment Act of 2002. It is generally accepted by the Government and its critics alike that the policy scene in South Africa in the period since 1994 has been characterized by good policies but poor execution. This is, however, a relatively untested hypothesis and needs further investigation. In the light of this, it is anticipated, that the present study will make a contribution to the literature on policy implementation in South Africa, as well as providing useful insights and lessons that can inform general government policy in this regard, and policy with respect to juvenile justice in particular. ▼ Section 28(2) of the South African Constitution determines that every child has the right to have their best interests considered of paramount importance in all matters concerning them. Section 9 further provides that every person is considered equal before the law and has the right to equal protection and benefit of the law. Several grounds are listed relating to the unfair discrimination of persons, including their sexual orientation. The concept of care is incorporated in the Children's Act, and it entails a comprehensive description of parents' daily life regarding their children and the powers and duties expected to ensure the general protection, well–being and best interests of the child. The study aims to research the legal position when the sexual orientation of a parent is a considering factor in the granting of care, and the extent of which courts can give consideration to that factor. I commence by examining relevant national legislation relating to the concept of care and the best interests of the child standard in the Children's Act to establish how the sexual orientation of a parent is interpreted by courts in the granting of care. I then proceed to examine relevant international and regional documents to determine the relevant rights relating to the interests of children in the granting of care to a parent in divorce proceedings. I then proceed to analyse landmark cases to establish ways in which the approach of the courts regarding homosexuality have changed since the beginning of the new political dispensation in 1994. Finally a conclusion will be reached on the nature and scope of the consideration of a parent's sexual orientation in the granting of care in the South African context.

▼ This study explores the international obligations of the European Union to the unaccompanied asylum-seeking and refugee
child. In doing so, it involves an investigation into the concept and content of durable solutions for the refugee
child. As such, it analyses the effect of the temporary European relocation scheme in the search for durable solutions. To that end, it engages a comprehensive explanation of the relevant refugee law, the law of the rights of the
child and the European legislative framework governing the reception and protection of refugees. Cumulatively, an assessment is made as to the effectiveness of the durable solutions that currently exist. This study seeks to establish whether, in an attempt to relieve the pressure from the frontline member states by creating a system for effective integration, Europe encourages the development of a children’s rights perspective and ultimately, provides a path for the unaccompanied child’s
development and self-fulfilment.

Na afloop van die afsterwe van 'n ouer, vind daar fisieke, emosionele, sosiale en kognitiewe veranderinge in die kind se lewe plaas waarop hy nie voorbereid is nie, en wat hy ook nie verstaan nie. Hierdie veranderinge veroorsaak dat die kind se leefwereld in so mate verander dat sy funksionering benadeel word. Daar is met hierdie studie gepoog om vas te stel watter effek die dood van 'n ouer op die kind he! en tot watter mate terapeutiese begeleiding die kind se emosionele nood kan verlig. Daar is in die studie gevind dat rou inderdaad 'n gekompliseerde proses is wat lei tot die ontstaan van talle onbeantwoorde vrae, gevoelens van magteloosheid en emosionele pyn. Kinders wat in rousmart verkeer word dikwels deur die samelewing misgekyk en kry as gevolg hiervan nie voldoende hulp nie. Di! lei tot die ontstaan
van persoonlikheidsontwikkelingsprobleme, relasionele probleme en intra-psigiese probleme soos 'n swak selfbeeld, ego-verdedigingsmeganismes, persoonlike kwesbaarheid, ongunstige betekenisgewing en ongunstige belewenisse. Hierdie probleme veroorsaak dat die kind in sy selfaktualisering gerem word en as gevolg hiervan nie sy gegewe moontlikhede verwerklik nie. Die studie het verder bewys dat die kind wat 'n ouer aan die dood afgestaan het, wel deur middel van terapeutiese begeleiding deur 'n sielkundige gehelp kan word om die verlies van 'n ouer in so 'n mate te hanteer dat die faktore wat die kind se selfaktualisering rem, opgehef kan word. Die studie voorsien die sielkundige van riglyne ten opsigte van die proses van terapeutiese begeleiding aan die kind wat 'n ouer aan die dood afgestaan het.
