Following the initiation of the European Union Emissions Trading Scheme (EU ETS) in 2005 the scheme has received significant criticism pertaining to a lack of transparency in its operational mechanics and an inability to present conclusive evidence that it has encouraged a reduction in monitored emissions. This study utilizes an adaptation of the event study methodology proposed by Ball and Brown (1968) and Fama et al. (1969) in order to assess the impact of the EU ETS on emissions in the European oil and gas sector as a sample reflective of the scheme on the whole. In doing so, this study compares the annual emissions of carbon dioxide, nitrous oxide and methane for dual listed, single listing and cross listed oil and gas companies on the New York Stock Exchange and the London Stock Exchange and how these emissions change over the period 2000-2017; from prior to the EU ETS until the period of most recent data availability. Analysis conducted on the data gathered infers that, while the EU ETS may have exerted some influence on operators’ behavior, the scheme has generally been ineffective in achieving its goal of lowering emissions and encouraging economic growth. This study also explores the limitations of the EU ETS and potential drivers of emissions changes for operators within the scheme. Through such discussion the intention is to better understand the tradeoff between the advantages of cap-and-trade, a quantity mechanism, and emissions taxation, a pricing mechanism. These mechanisms comprise the majority of the presently adopted emissions policies globally, including the EU ETS, and China’s and Canada’s emissions trading schemes. Therefore, in better understanding the implications and effects of these mechanisms, the intention is to contribute to the future adoption and implementation of global emissions policies. Energetska učinkovitost je način za zagotavljanje zmanjševanja emisij toplogrednih plinov, zmanjševanja odvisnosti od zunanjih uvoznikov olja in plina, torej povečevanja energetske varnosti in neodvisnosti ter način za zagotavljanje trajnosti in energetskih prihrankov. Energetsko učinkovitost v Evropski uniji neposredno urejajo predvsem štirje temeljni akti, ki pokrivajo vsak svoje temeljno področje. Direktiva 2012/27/EU o energetski učinkovitosti, ki jo spreminja Direktiva (EU) 2018/2002, kot krovna direktiva splošno ureja področje energetske učinkovitosti, Direktiva 2009/125/ES Ecodesign ureja energetsko učinkovitost produktov, Direktiva 2010/31/EU o energetski učinkovitosti stavb, ki jo spreminja Direktiva (EU) 2018/844, ureja energetsko učinkovitost stavb in skuša uresničiti velik energetski potencial na področju stavb. Uredba (EU) 2017/1369 o energetskem označevanju ureja obveznost označevanja energetske učinkovitosti pri različnih kategorijah produktov. Leta 2016 je Evropska komisija sprejela predlog zakonodajnega paketa − »Zimski paket« oziroma »Čista energija za vse Evropejce«. Namenjen je področju energetske zakonodaje, ki prinaša spremembe na že urejenih področjih energetske učinkovitosti stavb in energetske učinkovitosti. V okviru zakonodajnega paketa sta bili sprejeti Direktiva (EU) 2018/2002 o energetski učinkovitosti in Direktiva (EU) 2018/844 o energetski učinkovitosti stavb, poleg tega pa je bilo na novo urejeno področje upravljanja energetske unije s sprejemom Uredbe (EU) 2018/1999 o upravljanju energetske unije. Energijski paket ohranja, razširja in na novo postavlja ambicioznejše in dolgoročnejše cilje v zvezi s spremembami že obstoječe ureditve. Uredba o upravljanju energetske unije (2018/1999) na novo določa postopke poročanja, nadzora in postopek v primeru neskladnosti razvoja nacionalnih politik držav članic s krovnimi cilji energetske unije. Temeljno načelo energetske unije je »energetska učinkovitost na prvem mestu«. Slednji se pripisuje tolikšen pomen, da je v evropskem pravnem redu opredeljena kot svoj energetski vir. Cilj je predstaviti pomen in vsebino ureditve energetske učinkovitosti v Evropski uniji, sistematično predstaviti ukrepe, ki urejajo to področje, ter pomen, ki ga je energetska učinkovitost pridobila znotraj evropske agende po dekarbonizaciji.

Cette thèse couvre deux sujets : le dessin des permis à polluer et la gestion des déchets. Le premier chapitre analyse la mise en œuvre des permis à polluer. Le chapitre se concentre sur les impacts de la distribution liés à la sévérité de l’allocation gratuite basée sur la production courante quand deux secteurs sont couverts par le marché des permis et le plafond reste constant. Un nouveau type d’augmentation des profits dans les secteurs qui ne sont pas exposés à la concurrence internationale a été démontré théoriquement. Le deuxième chapitre traite la question de la différenciation de l’allocation des permis dans les différentes régions, liée à la possibilité des entreprises à délocaliser. Les conditions dans lesquelles le bien-être décroît avec la délocalisation sont déterminées. Dans ce cas, des distributions gratuites de permis peuvent être utilisées pour éviter la délocalisation des entreprises. Le troisième chapitre compare l’efficacité des programmes de la responsabilité élargie du producteur (REP) avec l’efficacité d’une ex-ante taxe. La taxe permet plus de flexibilité ex-ante quant aux conditions du marché, mais la REP permet plus d’adaptation ex-post aux réalisations des coûts. Ainsi, l’efficacité relative de la REP augmente avec l’incertitude des coûts et la compétitivité du marché.

This thesis covers two subjects. One is the design of pollution permits and the other is the waste management. The first chapter analyses the implementation of pollution permits. It focuses on the distributional impacts linked with the stringency of output-based allocation,when two sectors are covered by the market for permits and the total cap is held constant. Theoretically demonstrated is a new type of profit increase in sectors that are not exposed to international competition. The second chapter addresses the issue of differentiating permit allocation across areas, this being linked to the possibility of firms to relocate. The conditions under which welfare decreases with relocation are determined. In such a case, free allowances may be used to prevent firms from relocating. The third chapter compares the efficiency of extended producer responsibility (EPR) programs and the efficiency of an ex-ante tax. The tax allows more ex-ante flexibility regarding market conditions, but the EPR allows more ex-post adaption to cost realizations. As a result, the relative efficiency of the EPR increases with uncertainty of the costs and competitiveness of the market.
