▼ Dans un cadre mondial, les relations commerciales peuvent être soumises à la compétence d'une pluralité de juridictions, aussi, les outils juridiques permettent-ils la conclusion de conventions de juridiction. Pour autant, ils ne les qualifient pas. Ces conventions peuvent pourtant être rattachées à la matière contractuelle ainsi qu'à la matière procédurale et cette nature duale ressort de la jurisprudence nationale. La doctrine ne s'accorde pas non plus sur la qualification adéquate à retenir. Enfin, malgré l’entrée en vigueur du Règlement 1215/2012 et de la Convention de La Haye de 2005, ce caractère hybride emporte des conséquences en termes de loi applicable. Afin d'améliorer l'efficacité des conventions de juridiction et d'assurer une plus grande sécurité juridique, la thèse envisage une approche téléologique de ces conventions. Elle consiste à s'interroger sur la finalité des outils relatifs à ces dernières : de protection et de promotion des rapports commerciaux. Sur cette base, l'adoption de solutions matérielles et leur cadre juridique peuvent être envisagés.Matériellement, il s’agit de l'intérêt d'une qualification téléologique des conventions de juridiction et du choix de la qualification adéquate. Intimement liée à la qualité des parties, elle fournit l'occasion de redéfinir les critères de distinction de ces acteurs. Le cadre juridique consiste à démontrer l'intérêt d'adopter un instrument international portant une telle qualification et celui de cette qualification autonome.
In international contracts, there are many potential competent jurisdictions. This leads to insecurity for contractors and can discourage the formation of international contracts altogether. Given this concern, the legal instrument will provide an agreed upon jurisdiction. However, in many instances the instrument does not specify how these jurisdictional agreements should be characterized. Such provisions could be characterized as contractual or as procedural. As a result, national jurisdictions do not all appreciate such agreements in the same way. What’s more, the legal scholars, will agree on the relevant legal characterization of these jurisdictional agreements. This problem persists despite the express statement by the Convention of 2005, and Regulation 1215/2012, that the lex fori designated by the agreement should be used in determining the substantial validity of such jurisdictional agreements. Indeed, because of this difficult characterization that influences the applicable law, in practice these jurisdictional agreements cannot produce consistent and uniform results amongst all nations. This work aims to analyze the approach of international legislation as well as European legislation. This analysis highlights the two important policy goals underlying the legislation: (1) protection of the weaker contracting party; and, (2) promotion of successful formation and enforcement of international contracts between professionals. ▼ Corruption is a global phenomenon which every society faces though its degree of severity varies
from country to country. Despite its long history, there is no single universally agreed upon
definition of corruption. Moreover, its causes, forms and impacts are diverse and multi-faceted.
Understanding corruption by itself is a complex undertaking. However, it is agreed that
corruption is inimical to public administration, undermines democracy, degrades the moral
fabrics of the society and violates human rights. The pain of corruption touches all the human
family but it disproportionately affects the vulnerable sections of the society. It reinforces
discrimination, exclusion and arbitrariness. Corruption is a universal problem undermining
universal value- human rights.
The international legal regime against corruption takes a political and economic view point in
addressing corruption. The measures adopted are not sufficient to give response to victims of
corruption. The anti-corruption
conventions did not address the human rights impact of
corruption while it violates different set of human rights. Moreover, the monitoring mechanisms
of the anti-corruption
conventions are weak even to implement the covenant provisions.
The thesis advocates for the elevation of the human right to corruption-free service as a panacea
to the weaknesses of the anti-corruption
conventions. Investigation of the existing literature on
the relationship between corruption and human rights reveals that corruption per se is a
violation of human rights and hampers the global movement for the enforcement of human rights
on the one hand and a culture of human rights can be a preventive tool for corruption on the
other hand. The problem of corruption and the violation of human rights need an integral
approach. It is with this view that the human right to corruption-free service is put forward to
give meaning to the integral approach. Besides, the right to corruption-free service is an end in
itself rooted in human dignity and equality like the right to life, privacy and security.
Setting the fight against corruption within a human rights discourse by elevating corruption-free
service as a human right, will open an additional avenue for the fight against corruption and
opens a door for the realization of human rights. It is argued that the right to corruption-free
service is both a means for reducing corruption and instrumental for the enforcement of other
human rights. In addition, the existing human rights monitoring mechanisms such as
international and regional human rights commissions and courts, UN complaint mechanisms or
national human rights systems will be useful to remedy corrupt practices if corruption free
service is recognized as a human right.

▼ ENGLISH ABSTRACT: It is widely held that the documentary mode of filmmaking is a subjective endeavor. Bill Nichols identifies an unspoken contract between the viewer and the filmmaker, that what is seen is to be believed. Often, when it comes to documentary films, viewers neglect to acknowledge how the filmmaker goes about in selectively interpreting “reality” for an audience. Bertolt Brecht believed that it is the encoder's responsibility to make the viewer aware of construction processes in a given representation. In this way a critical involvement with the material is ignited and consequently the viewer distances herself emotionally from the representation. Self-reflexive modes of filmmaking foreground the subjective nature of film by highlighting the process of construction. The viewer is thus prevented from suspending her disbelief, and prompted to decode the material actively. These signifiers of reflexivity can be indicated by the overt involvement of the filmmaker and the inclusion of filmic equipment. The presence of the camera is often obvious in reflexive representations, and the viewer becomes acutely aware of how it might influence authentic behavior of the
subject filmed. The viewer is therefore not always able to see how a
subject might react in her natural environment. The camera essentially represents the presence of an observing other.
The documentaries to be discussed in this thesis all investigate subjects against a backdrop of social and interactive media. On these online platforms individuals are faced with the presence of gazing others who might interact or just voyeuristically observe. Here the
subject internalizes the gaze and acts according to how she imagines the desire of the gazing other. The various social networking platforms documented in these films provide the individual with an environment in which she can construct and re-construct an image of self until she attains what she imagines is considered as ideal. A flexible form of narration is thus born due to the technical features characteristic of such online environments. The self might always go back and adapt and further manage/manipulate her image of self as she feels persistently surveyed by a community of gazing equals. Here there exists no gazing hierarchy: everyone is visible to everyone all the time, making selective self-fashioning and subsequent self-documentation challenging. The film and computer screens in which the self sees a reflection of her constructed self becomes something of a mirror: when the self witnesses her own reflection in this screen/mirror, she is faced with psychological processes of self-contextualizing. She must attempt to live up to that which she believes is desired by her societal Other. The self, forever aware of the ubiquitous gazing others in these environments, is always adjusting her concept of self accordingly. ▼ Recent philosophical research on normativity has clarified the nature and dynamics of social norms. Social norms are distinguished from legal and moral norms on the basis of their scope, their grounds, their characteristic forms of accountability, or some combination of these features. Because of their distinct character, social norms can reinforce practical prescriptions, prohibitions, and permissions provided to particular actors by legal or moral norms. They also can conflict drastically with those prescriptions, prohibitions, and permissions – resulting in serious practical dilemmas.
The identification of normative principles capable of resolving practical dilemmas arising from conflicts between different kinds of norms is a major aim of contemporary moral and political philosophy. This dissertation contributes to this aim by establishing the significance of conflicts between social norms and legal or moral norms during mass atrocities and liberalizing political transitions. The dissertation argues that social norms, and changes in social norms, are critical components of accurate descriptions and responsible evaluations – both legal and moral – of the actions of individuals and groups before, during, and after mass atrocities. The dissertation contends, further, that distinct principles of justice may apply to transitional efforts by non-state actors to transform social norms in societies recovering from large-scale crimes.
Three principal results follow from this dissertation’s effort to integrate the conceptual framework of social norms into the study of mass atrocity. First, the dissertation clarifies and extends the historiographical thesis of norm transformation, according to which participation by ordinary individuals in mass atrocities is at least partially explained by transformations in basic norms that structure social and political life. Second, the dissertation identifies a novel basis on which to apportion legal and moral accountability for mass atrocities between individuals and groups or collectivities – i.e. on the basis of the specific contributions of social norms. Third, the dissertation provides new support for the disputed claim that distinct principles of justice apply to the various actors involved in liberalizing political transitions.

▼ La gestion des conflits est indiscutablement une préoccupation actuelle des opérateurs économiques qui en appellent fréquemment à leur volonté afin de prévenir, traiter, aménager ou résoudre les conflits, au sein du contrat d’origine, par le contrat ou dans le procès, s’appropriant ainsi l’œuvre de justice. La volonté des sujets de droit et l’ordre imposé par les différentes sources de droit s’entrechoquent alors avec une intensité variable selon qu’il s’agit du domaine contractuel ou processuel. De cette confrontation se dessinent les frontières de la liberté qu’il apparaît nécessaire d’éprouver. Apprécier le rôle de la volonté, individuelle ou conjointe, des parties ou des tiers, dans la gestion des conflits permet ainsi d’isoler plusieurs conceptions de la Justice, entre satisfaction d’intérêts privés, service public et réalisation d’un idéal universel. À cet égard, la position adoptée par le droit positif incite à se demander si une vision plus individualiste de la justice serait envisageable.
Conflict management is nowadays undoubtedly a major subject for economic operators who frequently mobilize their will in order to prevent, process, adjust or solve their conflicts, within the original agreement, by an agreement or during the proceedings, thus appropriating the art of justice. Individual will then confronts with the imposed order as defined by different mandatory legal sources with an intensity which varies depending on the contractual or procedural nature of the considered field. From this confrontation arise freedom’s boundaries which need to be challenged. Assessing the role of will, whether individual or joint, of the parties or of third parties, in conflict management enables the isolation of multiple conceptions of Justice, as private interest satisfaction, universal ideal achievement and public service. The position adopted by subtantive law invites to determine if a more individualistic view of justice is conceivable.

▼ Chromo stereoscopy (CS) is a simple and cost effective 3D system that can easily deliver geospatial information. CS has been used in several scientific data presentations, including remote sensing, physical modelling and hydrographic applications. In some of these applications the 3D effect was solely CS-related, while others integrated CS with other methods of implementing 3D. CS was mainly used in static visualisation, but no dynamic applications were found. Also, the restricted use of colour was acknowledged as a limitation for CS suggesting its unsuitability for applications where colour conventions are significant. This research focuses on CS for the marine applications and aims to (i) investigate users’ perception to CS effect and its interaction with other depth cues, (ii) assess the acceptance of the potential users to the changes in conventional colouring systems, (iii) and evaluate the usability and practicality of CS as an additional visualisation system in dynamic marine applications. To address these, visual scenarios were developed and expert human participants were recruited and interview for the evaluation. CS was well perceived among the participants. The interaction between different depth cues has advantages of increasing the depth perception and comprehending the 3D nature of the surrounding environment. For instance, from a certain view angle where two objects block each other, CS enhances the interposition effect, that indicates which object is in the front and gives a qualitative estimation of the spatial separation between them. Shading increases the realism of surface objects, and provides information for their undulation. It also dilutes the colours used in CS and increases the range of colours perceived and enhances the effect perceived from CS. The advantage of using the colour coding system to indicate distance is a valuable and original outcome of this thesis. This coding improved the participants understanding of the behaviour of moving objects (whether vessels coming closer or drifting apart) and enabled users to locate them in reference to the surrounding topography. Such knowledge is important to attain safer operations in a 3D environment. Accepting changes in colours in a visual presentation is linked to experience gained during interaction with the system, and the changes would be tolerated by the users in favour of improvements in situation awareness. Blind navigation and underwater operations are examples of where CS can be beneficial.

▼ Coding conventions are ubiquitous in software engineering practice. Maintaining a uniform coding style allows software development teams to communicate through code by making the code clear and, thus, readable and maintainable—two important properties of good code since developers spend the majority of their time maintaining software systems. This dissertation introduces a set of probabilistic machine learning models of source code that learn coding conventions directly from source code written in a mostly conventional style. This alleviates the coding convention enforcement problem, where conventions need to first be formulated clearly into unambiguous rules and then be coded in order to be enforced; a tedious and costly process. First, we introduce the problem of inferring a variable’s name given its usage context and address this problem by creating Naturalize — a machine learning framework that learns to suggest conventional variable names. Two machine learning models, a simple n-gram language model and a specialized neural log-bilinear context model are trained to understand the role and function of each variable and suggest new stylistically consistent variable names. The neural log-bilinear model can even suggest previously unseen names by composing them from subtokens (i.e. sub-components of code identifiers). The suggestions of the models achieve 90% accuracy when suggesting variable names at the top 20% most confident locations, rendering the suggestion system usable in practice. We then turn our attention to the significantly harder method naming problem. Learning to name methods, by looking only at the code tokens within their body, requires a good understating of the semantics of the code contained in a single method. To achieve this, we introduce a novel neural convolutional attention network that learns to generate the name of a method by sequentially predicting its subtokens. This is achieved by focusing on different parts of the code and potentially directly using body (sub)tokens even when they have never been seen before. This model achieves an F1 score of 51% on the top five suggestions when naming methods of real-world open-source projects. Learning about naming code conventions uses the syntactic structure of the code to infer names that implicitly relate to code semantics. However, syntactic similarities and differences obscure code semantics. Therefore, to capture features of semantic operations with machine learning, we need methods that learn semantic continuous logical representations. To achieve this ambitious goal, we focus our investigation on logic and algebraic symbolic expressions and design a neural equivalence network architecture that learns semantic vector representations of expressions in a syntax-driven way, while solely retaining semantics. We show that equivalence networks learn significantly better semantic vector representations compared to other, existing, neural network architectures. ▼ This Ph.D. dissertation focuses on the nostalgic feelings of the Andalusian Arabs and Jews toward the East and on the role that eastern poetic
conventions played in the literary composition of al-Andalus.
The first chapter introduces a quick survey of nostalgia among Arabs from the pre-Islamic era up to the modern era and shows how political and social instability incited this phenomenon among Arabs in general.
Chapter two introduces a lexicon of nostalgia by gathering the terms and vocabulary in Arabic and Hebrew that are often used in emotional, nostalgic poetry focused on the poet's roots and past.
Chapter three focuses on selected terms from the previous chapter (five types of plants and four eastern rivers) and examines how these terms were used in al-Andalus to show direct nostalgia for the East or indirect nostalgia by relying on and employing the eastern poetic
conventions. Chapter three also examines how the eastern poetic masterpiece "the muʿallaqa" of Imriʼ al-Qays functioned as inspirational poetry to many Andalusian poets, what indicates the strong literary bonds between al-Andalus and the East.
Chapter four discusses the impact of the Islamic religion on the increasing religious and geographical nostalgia for the East in al-Andalus. Sufi poetry and poetry praising the Prophet Muḥammad (madīḥ nabawī) were discussed in this chapter to shed light on this phenomenon.
Chapter five focuses on rithāʼ al-mudun (the elegy for the fallen cities of al-Andalus) and argues that, even when the Andalusian poet intended to express sorrow and pain over the loss of the Andalusian cities, he almost always referred to the East and the eastern poetic convention of the nasīb to convey his feelings.
Chapter six focuses on the non-religious nostalgia of some Jewish Andalusian poets for Jerusalem, in particular, and the Land of Israel, in general. In this chapter, I argue that the insults aimed at Jews and Judaism increased these poets' feelings of not belonging and, as a result, increased the nostalgia for personal redemption among the Jews, in general, and in Shmuʼel Hanagid and Yehuda Halevi, in particular.

La volonté des sujets de droit et l’ordre imposé par les différentes sources de droit s’entrechoquent alors avec une intensité variable selon qu’il s’agit du domaine contractuel ou processuel. De cette confrontation se dessinent les frontières de la liberté qu’il apparaît nécessaire d’éprouver. Apprécier le rôle de la volonté, individuelle ou conjointe, des parties ou des tiers, dans la gestion des conflits permet ainsi d’isoler plusieurs conceptions de la Justice, entre satisfaction d’intérêts privés, service public et réalisation d’un idéal universel. À cet égard, la position adoptée par le droit positif incite à se demander si une vision plus individualiste de la justice serait envisageable.
Conflict management is nowadays undoubtedly a major subject for economic operators who frequently mobilize their will in order to prevent, process, adjust or solve their conflicts, within the original agreement, by an agreement or during the proceedings, thus appropriating the art of justice. Individual will then confronts with the imposed order as defined by different mandatory legal sources with an intensity which varies depending on the contractual or procedural nature of the considered field. From this confrontation arise freedom’s boundaries which need to be challenged. Assessing the role of will, whether individual or joint, of the parties or of third parties, in conflict management enables the isolation of multiple conceptions of Justice, as private interest satisfaction, universal ideal achievement and public service. The position adopted by subtantive law invites to determine if a more individualistic view of justice is conceivable.

▼ AbstractStudents’ skills in effective written communication are an essential and integral part of university education in both native and non-native speaker context. Focus of this study is on science writing in native speaker context. However, there is limited research on undergraduate writing in science. Research shows that such studies directly impact on student performance since they contribute to enhance pedagogies for academic literacy. The need for such studies has been highlighted by reports such as National Association Physics Teachers and National Science Foundation. Writing a laboratory report is an activity that models the writing of a scientific paper. Hence, this study focused on examining laboratory report writing (specifically introduction sections and discussion sections) and aimed to provide insights and implications for teaching and learning of laboratory report writing.A diverse sample of laboratory reports including different year levels and different subjects were chosen from two prestigious universities in Australia. The Swales CARS (Create-A-Research-Space) model (2004), which has been used extensively to analyse Research Articles (RA) in science was used as one analytical tool in this study to identify commonly used “Moves” by the students. Further, Hyland’s (2004), metadiscourse model for academic writing was used to identify common linguistic features used in undergraduate laboratory reports. The study found that novice writers follow most of the practices of expert writing, with only minor differences in laboratory reports between different year levels and different
subject areas. The main difference is that laboratory reports lack some of the “Moves” of research articles. Research placement reports were found to be more consistent with the CARS model. The difference between laboratory reports and research placement reports can be attributed to the different learning outcomes of the two activities. This study contributes to the development of pedagogy of academic literacy practice and teaching laboratory report writing by suggesting two new models, based on the CARS model, for teaching report writing. These are presented as flowcharts in simple English, making them accessible to students. Further, this study highlights the importance of effective collaboration between science academics and literacy practitioners. A common understanding between disciplinary academics and EAP practitioners regarding the writing
conventions, disciplinary differences and expected learning outcomes would be beneficial for student learning and their performance.

▼ Many Australian artists returning from a prolonged stay overseas will be familiar with the crippling question upon their return- What now? After returning to live in Australia after living in Scotland for six years I faced many adjustments and challenges. As an artist who mainly works within the landscape genre, I struggled to find inspiration and a personal connection to my new home on the Central Coast, as it was so vastly different from the Scottish environment to which I had become accustomed. I questioned why had I found it so difficult to find inspiration in my new home? Also how does one use the skills and knowledge gleaned from working in a different landscape to a new one? Looking into the practice of Australian landscape artists has helped answer some of these questions. It was a comfort to find Australia has a long history of immigrant artists who struggled to come terms with their new environment. Artists have been arriving in Australia from Europe since the beginning of British Colonisation and bringing with them their preconceived ideas relating to the depiction of the landscape. It was this cultural background which created a framework through which European artists viewed Australia. This research is an investigation into how myself and other contemporary Australian landscape painters are still influenced by the traditions and
conventions of nineteenth century landscape painting.

▼ In evaluating the International Conference on Foreign Student Affairs at the University of British Columbia, an attempt was made to develop instruments for assessing the achievement of objectives, to determine if differences existed in individual and group methods of evaluation, and to determine
if there were differences in evaluative responses between those who took part in a pre-conference survey on personal objectives
and those who did not. Pre-conference data consisted of participants' personal objectives in attending. Data collected at the end of the conference included personal and socio-economic characteristics of participants; Kropp-Verner Attitude Scale measures; and evaluative measures of components
of the conference.
The twelve factors extracted from the attitudinal measures by factor analysis confirmed the original partitioning
of the evaluation instrument. The occurrence of two factors within the Kropp-Verner Attitude Scale indicated that it was not unidimensional when applied to the population studied.
To determine the effects of individual and group methods of evaluation, participants were assigned to one of three experimental conditions. Those in the Individual Non-Cooperative Condition filled out the evaluation form by themselves;
those in the Individual Cooperative Condition were permitted to converse with others; and those in the Group Cooperative Condition publicly stated their evaluation. Significant differences were found between the Individual Non-Cooperative and Individual Cooperative Conditions and between the Individual Non-Cooperative and Group Cooperative Conditions. The Group Cooperative Condition produced the greatest consensus of opinion and the Individual Cooperative Condition had the highest response means. Two discriminating variables, "communications" and "controls and influences" were extracted by stepwise discriminant analysis for the first administration of group process questions. The variables
"communications" and "process" were discriminators in the second administration.
In comparing the evaluative responses of participants
who received and returned the pre-conference survey on objectives, those who received but did not return the survey, and those who did not receive it, the only statistically
significant difference was found between those who received but did not return the questionnaire and those who did not receive it. The objectives pertaining to "Intra-NAFSA Affairs" and "Government Policies" were extracted in stepwise discriminant analysis.
The 3 x 3 x 10 factorial analysis was carried out to test the combined influence of the group process questions, the experimental conditions, and the pre-conference survey conditions on the amount of change in responses. Significant F ratios were obtained on the pre-conference survey conditions and on the interaction of the survey conditions with the group process questions. ▼ La thèse porte sur les évolutions de la relation de crédit des collectivités locales et étudie différentes formes que celle-ci a pu prendre au cours du temps. Tout particulièrement, sur la période récente, nous mettons en évidence l’émergence et l’institutionnalisation de ce que nous identifions comme une « forme financiarisée », caractérisée par l’utilisation de produits financiers distribués sur les marchés financiers dans la gestion de dette des collectivités locales. Nous développons une approche institutionnaliste où la relation de crédit, et ses transformations historiques, sont saisies à partir des régulations qui encadrent, de manière plus ou moins lâche, la demande de crédit émanant des collectivités locales, d’une part, et l’offre de crédit des acteurs financiers, d’autre part. Nous cherchons notamment à rendre compte de la manière dont les interactions entre demande et offre de crédit sont conditionnées et en partie déterminées au niveau institutionnel. Deux types de pratiques d’emprunts que nous qualifions de financiarisés sont au centre de ce travail : l’emprunt structuré et l’emprunt obligataire. Nous suivons le développement à partir des années 1990 des produits structurés qui seront au centre de la crise des emprunts dits « toxiques », ainsi que les formes de gestion puis de sortie de cette crise (2004-2015). Sur la même période, des émissions obligataires groupées de collectivités locales sont développées et vont déboucher sur la création de l’Agence France Locale (AFL), dont nous suivons la structuration (2004-2018). Nous montrons que la période d’incertitude qui s’ouvre à compter de la crise financière de 2008 contribue paradoxalement à la poursuite et l’institutionnalisation du recours, pour les collectivités locales, à des produits faisant appel aux marchés et investisseurs financiers. Ce résultat n’était pas écrit dans la mesure où la crise des emprunts toxiques nourrit une vive critique d’une forme financiarisée qui s’était développée « par le bas » dans un contexte de libéralisation financière pour le prêt aux collectivités locales et de décentralisation. Le moment de réflexion institutionnelle, qui s’ouvre avec la crise, conduit les acteurs à tenter de dissocier la « mauvaise » finance de la « bonne » pour mieux pouvoir continuer à recourir à des formes d’emprunt financiarisées. L’enquête par entretiens (n= 61) et la collecte d’une abondante littérature grise se sont organisées principalement autour du décryptage des outils de gestion, dispositifs de gestion de crise et réglementations qui structurent la relation de crédit. Nous les décodons sous l’angle des conventions qu’ils incorporent et des présupposés qu’ils rendent légitimes, ce qui nous permet d’en souligner les effets de sélection et de disciplinarisation. En ce qui concerne l’emprunt structuré, ce travail est complété par une analyse statistique et économétrique portant sur les communes « intoxiquées » et permettant de discuter des déterminants du développement du recours à ce type d’emprunt.

▼ Ce travail porte sur une étude de l’efficacité des régimes protecteurs d’investissements directs étrangers actuellement au Cambodge, en faisant une comparaison avec ceux connus des pays étrangers, spécialement de la France. La protection internationale des investisseurs directs étrangers se définit comme l’ensemble des principes et des règles, de droit international comme de droit interne, qui ont pour objet ou pour effet d’empêcher ou de réprimer toute atteinte publique à l’existence ou à la consistance de l’investissement international. La sécurité de l’investisseur étranger est un point essentiel pour attirer des investissements internationaux. L’atteinte publique ou une mesure prise par le Cambodge ne peut pas créer des obstacles à l’investissement étranger. En voulant protéger mieux des investisseurs directs étrangers, le Cambodge est en train de se doter de règles juridiques, spécialement le droit des investissements afin d’attirer des investisseurs étrangers. C’est la raison pour laquelle, le Cambodge a adhéré à l’Association des Nations de l’Asie du Sud-Est (ANASE ou ASEAN) en 1999 et à l’OMC le 13 octobre 2004. Le Cambodge coopère également avec d’autre Pays en concluant des conventions bilatérales dans la matière de la protection de l’investissement.
This work focuses on a study of the effectiveness of the current legal rules which protect foreign direct investments in Cambodia, by making a comparison with the foreign countries’ legal rules, especially the French legal rules. The international protection of foreign direct investment is defined as the set of principles and rules of international law and domestic law, which have as their object or effect of preventing or suppressing any public detriment to the existence or consistency of international investment. The security of the foreign investor is a key point for attracting international investments. Public involvement or action taken by Cambodia can not create barriers to foreign investment. In wanting to better protect foreign direct investors, Cambodia is establishing legal rules, especially the investment law to attract foreign investors. That is why, Cambodia joined the Association of Asian Nations Southeast (ASEAN) in 1999 and the WTO on October 13, 2004. Cambodia also cooperates with another Country by concluding bilateral agreements in the field of the protection of the investment.

▼ Le transport maritime, étant un levier du commerce international, traduit l’expansion du domaine de la commercialisation maritime des biens et services. Ce type de commerce existe depuis des siècles mais il connait un nouvel essor du fait de la mondialisation économique. Le transit par la mer concerne 80% à 90% en tonnage des marchandises échangées dans le monde, autrement dit cette économie représente les 4/5 de l'ensemble de l’économie planétaire. De ce fait, cette problématique implique une approche théorique et pratique, nationale, certes, mais aussi internationale par l’intérêt de comparaisons avec d'autres pays à vocation maritime dans un contexte qui ne cesse d'évoluer aux plans économique, technique, commercial ainsi que juridique. Cependant, nombre de questions soulevées avec acuité pour mieux cerner le monde du transport maritime avec l'ensemble des entreprises qui le forment, des services qui s'y rattachent, des moyens et systèmes qui lui sont propres pour effectuer les échanges permanents à travers le monde, participent à la réglementation juridique au vu d’une meilleure régulation socio-économique. En effet, face aux bouleversements phénoménaux liés à ce domaine, cette thématique dessine un cadre comparatif en matière de gestion portuaire, des instances juridiques qui opèrent pour le bon déroulement des lois applicables et des différentes conventions liées au transport maritime. Toutefois, la place du Sénégal en la matière nécessite un travail à la fois théorique et pratique afin de prendre en compte la juste importance du transport maritime à travers une analyse de la situation dans la région et au Sénégal ainsi que d’engager des perspectives pouvant conditionner l’amélioration du secteur.
Maritime transport, a support of international trade, expresses the expansion of the field of maritime marketing of goods and services. This type of marketing exists centuries ago but it knows a revival because of economic globalization. Maritime transit concerns 80 to 90 percent in tonnage from exchanged goods in the world, in others words, that economy represents the four – fifths of the whole global economy. Therefore, that problematic implies both a theoretical and pratical approach, certainly national but also international by the interest of comparing with other maritime countries in a context which is continually evolving n economic, technical, commercial and legal levels. ▼ Indigene Völker finden sich beinah täglich mit dem Umstand konfrontiert, dass sie weiterhin um gewisse Grund- und Menschenrechte kämpfen müssen, meist aufgrund der Tatsache dass sie in den Ländern, die sie bewohnen, eine Minderheit darstellen. Dies in Kontroverse zu der Tatsache, dass ihnen, auf Basis des Umstandes dass sie nicht eine dominante Gruppe in der Gesellschaft darstellen , zusätzlich zum allgemeinen Menschenrechtsschutz weitere, spezielle Rechte und Schutzpflichten von Seiten des Staates zustehen.
Besonders im Bereich der kulturellen, traditionellen und religiösen Rechte finden mit Regelmäßigkeit Rechtsverletzungen statt oder treten juristische Kontroverse auf, die Personen indigener Gruppen an einer freien und friedvollen Auslebung ihrer eigenen Kultur, ihrer Lebensform, hindern. Ein Konfliktbeispiel in diesem Zusammenhang ist die Koka-Pflanze, einerseits ein traditionelles, der Kultur inhärentes, Objekt der indigenen Kultur in den Anden, andererseits ein international pönalisierter und gefürchteter Rohstoff.
In dieser Arbeit ist es mein Ziel, ebendiese Dichotomie zu diskutieren, die aktuellen Debatten aufzuzeigen, beständige Bemühungen zur Legalisierung des Koka-Blattes von Vereinen, Organisationen und Vertretern indigener Völker, die sich für eine Streichung des Koka-Blattes von der Liste verbotener Substanzen der Drogen- Rahmenkonvention von 1961 bemühen, zu kanalisieren. Eine zentrale Argumentationslinie in dieser Hinsicht wird sein, dass Vertreter indigener Völker, wie auch Menschenrechtsvertreter, diese Streichung fordern, da ein Verbot des Koka-Blattes eine Verletzung der traditionellen, kulturellen und Identitäts- Rechte der indigenen Völker des Andenraumes repräsentiert und die Pflanze, als Kernelement der andinen Kultur, einen differenzierteren Status im internationalen Gesetz innehaben sollte. Indigene Völker des Andenraumes klagen, dass ihre spezifischen Menschenrechte verletzt werden, da ein inhärenter Teil ihres Seins auf internationaler Ebene unterdrückt und stigmatisiert wird, anhand der Drogengesetzgebung der Vereinten Nationen in diesem Bereich, und der respektiven Auswirkung auf regionaler Ebene.
Im Gegensatz dazu stehen die für die internationale Drogenkontrolle verantwortlichen Organe der UNO, wie etwa das International Narcotics Control Board (INCB), das in seinem letzten Statement in dieser Angelegenheit seinem rigiden Ansatz treu bleibt und weiterhin keinerlei Koka in keinerlei Form oder Art toleriert. Diese Politik kommt praktisch einer Illegalisierung des Koka gleich und verbietet jegliche Kommerzialisierung der Pflanze oder ihrer Blätter außerhalb der traditionellen Anbaugebiete: Bolivien und Peru .
Als Diskussionsbasis, sollen einerseits die relevanten internationalen Drogenkonventionen und –Abkommen, und andererseits die internationalen Gesetze über die Rechte indigener Völker , aber auch die allgemeinen Menschenrechtstexte, analysiert und in Beziehung gesetzt werden. ▼ La corruption, considérée comme l’utilisation abusive d’un pouvoir reçu par délégation à des fins privées, enrichit immanquablement un petit nombre de personnes. Ainsi, là où elle s’enracine, elle devient un obstacle important au développement en affaiblissant la société et l’Etat. C’est pourquoi, elle sape les fondements même de l’Etat de droit, mine les bases de la démocratie et tire sa source de la mauvaise gouvernance. Par conséquent, elle entraîne non seulement une mauvaise utilisation des deniers publics, mais également, fausse la concurrence en créant des inégalités entre les citoyens. Conscients des effets néfastes de ce phénomène, la France et le Mali prévoient et punis dans leur système juridique la lutte contre corruption. Au titre de la prévention, des organes à caractère administratif sont créés (SCPC en France et BVG au Mali, etc.) ayant pour mission de prévenir la corruption des agents publics. Egalement, sur le plan de la répression, des juridictions spécialisées sont créées dans ces pays pour réprimer toute atteinte à la probité publique. Mais force est de constater que la mise en oeuvre effective de ces mesures rencontre très souvent des difficultés tenant entre autres à la brièveté du délai de la prescription, à la question de l’opportunité des poursuites, au secret-défense, etc. Sur le plan international et régional, autant de conventions ou accords ont été adoptés pour faire de la lutte contre la corruption, un enjeu majeur. D’ailleurs, les Nations Unies ont inscrit la lutte contre la corruption au rang de leurs objectifs, considérant que ce fléau constitue à bien des égards, un obstacle majeur à l’Etat de droit. La France et le Mali ont ratifié et transposé la plupart des conventions internationales et régionales dans leur système juridique afin de se conformer aux contraintes internationales pour lutter contre la corruption, une lutte qui tend à s’internationaliser. Cette étude a pour objectif de faire un état des lieux de la corruption dans les deux pays, d’analyser la réalité et la faiblesse des mesures mises en place pour lutter contre ce fléau tout en faisant des propositions destinées à rendre plus efficace la lutte contre la corruption qui, au demeurant, gangrène tous les secteurs tant public que privé.
Corruption, considered as an excessive use of a power delegated for private purposes, inevitably enriches a small number of people. Thus, where it is rooted, it becomes a major obstacle to development by weakening the society and the state. Therefore, it undermines the very foundations of the rule of law, undermines the foundations of democracy and derives its source of bad governance. Consequently, it does not only lead to a misuse of public funds, but also distorts competition by creating inequalities among citizens. ▼ La finance solidaire se caractérise par un système de relations de financement entre des agents économiques : une relation de confiance découlant d'espaces de socialisation, une relation d'accompagnement facilitant la construction d'anticipations convergentes, et une relation financière stricto sensu. Elle s'inscrit dans les mutations socioéconomiques institutionnelles qui affectent l'offre et la demande de financement. Elle construit de nouvelles réponses à destination des agents productifs exclus du fait des transformations de la régulation financière, prenant ainsi en charge des espaces de financement périphériques nécessaire à la durabilité du système financier dominant. La finance solidaire est mise en œuvre par des organisations diversifiées partageant des caractéristiques particulières. Elle est l'expression d'une convention de financement solidaire territorialisée qui repose sur des modalités d'acquisition de l'information à la fois personnalisées et normalisées, sur des garanties collectives et sur l'association de différentes parties prenantes (associations, banques coopératives et lucratives, entreprises, collectivités territoriales). La diversité et l'articulation de ressources de nature différente engagent la finance solidaire à ancrer son action dans un compromis entre plusieurs logiques d'actions, aux fondements plus ou moins stables. Du fait de cette nature partenariale, les organisations de finance solidaire évoluent dans un environnement non concurrentiel qui assure néanmoins des moyens de financement pour la re-dynamisation d'une partie des activités économiques de proximité. Elle contribue ainsi à l'adaptation du système financier tout en proposant de diffuser des règles de financement innovantes.
‘Solidarity-based finance' is characterized by a system of funding partnerships between economical operators : a trust-based relation emerging from social interactions, a stewardship enabling convergent anticipations, and a financial partnership. It operates in socio-economic institutional mutations which affect the supply and demand of funding. It offers new opportunities to productive operators excluded by financial regulation transformations. Therefore, peripheral financial activities required to sustain the dominant financial system are taken into consideration. The ‘solidarity-based finance' is implemented by various organizations sharing specific characteristics. This unique concept is based upon territorialized solidarity-based funding agreements that are defined by information acquiring mechanisms (which are individualized but nonetheless normalized); collective commitments and association of various stakeholders (civil society, cooperative banks, local authorities, corporations). The diversity of resources and their interactions compel ‘solidarity-based finance' to anchor its role in a mediation between several policies, with more or less solid ground rules. ▼ La théorie de la diffusion de l’innovation s’est constituée au cours du XXeme siècle autour de modèles qualitatifs et quantitatifs qui ne prennent pas en compte, sinon à la marge, l’influence des valeurs et des normes dans la genèse de l’adoption des innovations. A partir d’une hypothèse de recherche, la « structure complexe » d’Edgard Morin et Jean-Pierre Dupuy, et d’une synthèse épistémologique, ce travail de recherche propose une échelle de mesure expérimentale des « cités » de Boltanski et Thévenot et l’intégration de l’influence des conventions comme variables antécédentes de l’adoption des innovations dans un modèle d’équations structurelles inspiré d’une modélisation classique de comportement du consommateur, la théorie de l’action raisonnée de Fishbein. Appliqué au terrain des émissions de télévision, ce modèle indique que l’adoption des émissions dites de « téléréalité » et le bulletin télévisé de la météorologie répondent à des influences normatives différentes qui impliquent des comportements différenciés chez le téléspectateur lors de la consommation de ces programmes. La modélisation de l’influence des conventions ouvre la voie à une classification inédite des émissions de télévision, en fonction des influences sociales, et, en lien avec l’audience, à une meilleure anticipation du succès des nouveaux formats télévisuels.
The theory of the diffusion of innovations has been built during the XXth century around qualitative and quantitative models which does not take into account, otherwise barely, the influence of values and norms on the genesis of innovations. From a research hypothesis, the “complex structure” thought by Edgar Morin and Jean-Pierre Dupuy and an epistemic synthesis, this thesis proposes an experimental measure scale of the Boltanski and Thevenot’s “worlds” and the implementation of sociological forms, “the conventions”, as variable of the innovation adoption in a structural equations model inspired from the Fishbein’s Theory of reasoned action. Built on the field of Tv programs, this model shows that the adoption of “reality TV programs” are linked with specific sociological influences. These sociological influences involve atypical behaviors of TV viewers in front of the screen. The model of the influence of the “conventions” on consumer behavior opens the way to a new classification of TV programs as well as an improved prevision of the success of new formats.

▼ Returning sovereignty to a vanquished county
after a state on state war can be accomplished by a belligerent
occupation and jus post bellum phases. The concept of belligerent
occupation was developed by the French to take the place of
conquest after a state on state war. Belligerent occupation seeks
to return the sovereignty back to the vanquished rather than
retaining control over that defeated people and territory. In the
last quarter millennium, the diplomats, the militaries and the
courts have established the concept of belligerent occupation but
with varying success due to a lack of planning for this end. With
the careful and extensive planning for the Allied occupation after
the Second World War success was attained albeit with great effort
during the belligerent occupation. Comparing the occupations of
Germany, Japan, and Iraq several additional planning indicators are
advanced for the successful completion of a belligerent occupation.
Indicators deal with the occupation plans and planning for
implementation, how the victors are viewed, a functioning
government in the vanquished country, the homogeneity of the
vanquished population, the size of the country and population of
the defeated state, the length of the war prior to occupation, and
the anticipated length of the occupation. The extant treaty based
occupation laws under The Hague and Geneva
Conventions provide a
sufficient legal basis for a successful belligerent occupation.
These planning indicators supported by the treaty law can only be
effective once there is sufficient control and security in the
vanquished country to begin the state building process. The ideal
belligerent occupation requires a military victory, a peace
agreement, a commitment to reconstruction, and a promise to return
their sovereignty to the vanquished. A final step to prepare the
vanquished for a return of sovereignty is a jus post bellum phase
addressing retribution, rebuilding, reparations, reconciliation,
and proportionality. Impediments to the ideal belligerent
occupation are considered along military and legal lines of
analysis. A policy relevant proposal using the United States as the
example is offered to focus on the planning details and assigning
responsibility for the specific tasks. The call for a Post-Conflict
Planning Cell with the concomitant coordination in a “whole of
government” and “whole of nation” approach is
proposed.

▼ Le commerce équitable (CE) a connu une forte croissance depuis les années 90. Malgré ce succès, leCE fait l'objet de différentes critiques, notamment concernant sa proximité avec les grands groupesagroalimentaires et la grande distribution. Ce rapprochement caractérise, pour certains, une perte desvaleurs éthiques du CE qui intégrerait des valeurs capitalistes. Or, le CE s'est construit en réaction à cesvaleurs capitalistes. La littérature est importante concernant ces tensions au Nord mais au Sud il estgénéralement question de l'impact du CE sur les producteurs.Nous proposons dans ce travail de nous interroger sur les tensions pouvant exister dans le systèmeCE au Sud, avec une entrée par les coopératives certifiées. Au cours de trois séries d'enquêtes auprès descoopératives de café certifiées par FLO au Costa Rica, nous avons réunis des données quantitatives etqualitatives. A travers le champ de l'économie des conventions, nous montrons que les coopérativescertifiées(i) s'inscrivent dans des mondes différents avec une forte disparité concernant lesmondes civique (collectif) et domestique (traditionnel),(ii) présentent des conventions d'effort très différenciées.Ces éléments expliquent un engagement hétérogène des coopératives dans le commerce équitable :certaines se certifient en portant des croyances fortes sur un lien plus rapproché entre producteurs etconsommateurs quand d'autres ne voient dans le CE qu'une opportunité marketing. Les valeurs marchandessont cependant communes à toutes les coopératives. Nous achevons notre travail en proposant des élémentsde réflexions quant au compromis qui semble s'être créé autour du monde marchand dans le système CE.Ce compromis remet en cause le contrat moral passé dans le cadre du CE entre consommateurs etproducteurs et interroge fortement sur l'avenir du CE.
Fair trade (FT) has known a strong growth since the 1990's. In spite of its success, FT is the objectof different criticisms, notably concerning its closeness with big companies and supermarket distribution.This proximity characterizes, for some people, a loss of the ethical values and an integration of capitalistvalues: the problem is that FT was built in reaction to these capitalist functioning. Literature is importantconcerning these tensions in the North, whereas in the South it is generally a matter of the impact of FT on producers.The purpose of this research is to analyze the tensions that can exist in the FT system in the South,with an entrance by the certified cooperatives. In the course of three series of inquiries about the coffeecooperatives certified by FLO in Costa Rica, we collected quantitative and qualitative data. ▼ L'analyse des textes internationaux démontre que les règles du droit anglo-américain sont les plus sollicitées pour régir les contrats internationaux dès leur formation et jusqu'à leur extinction. La combinaison de différents facteurs explique ce phénomène actuel d'influence du droit anglo-américain et dévoile son ampleur. D'une part, le phénomène de la mondialisation, qui s'exprime essentiellement par l'internationalisation de l'économie, a entraîné une concurrence entre les nations, relative à l'attractivité de leur droit. La flexibilité et le pragmatisme du droit anglo-américain semblent, d'autre part, l'avoir emporté sur le légicentrisme du droit civil. Enfin, l'expansion des outils issus de l'analyse économique du droit dans les différents systèmes juridiques cosmopolites matérialise indubitablement ce phénomène anglo-américain de pénétration de la dimension économique dans la sphère juridique. Par ailleurs, plusieurs mécanismes contractuels anglo-américains sont importés dans les projets d'unification du droit des contrats; ceux-ci véhiculent effectivement la philosophie juridique des « commonlawyers ». Par rapport aux autres normes incorporées dans les textes internationaux essentiellement du droit romano-germanique, l'intégration des règles anglo-américaines a abouti à un renforcement des principes directeurs de la liberté et de la loyauté contractuelle ainsi qu'un affaiblissement du principe de la sécurité contractuelle
The analysis of international texts shows that the rules of Anglo-American law are the most used to regulate International contracts from their formation until their extinction. The combination of various factors explains this current phenomenon of influence of Anglo-American law and reveals its magnitude. On the one hand, the phenomenon of globalization, which is expressed essentially by the internationalization of the economy, has led to competition between nations for the attractiveness of their norms. The flexibility and pragmatism of Anglo-American law, on the other hand, seem to have prevailed over the legitimacy of civil law. Finally, the expansion of the tools resulting from the economic analysis of the law in the different cosmopolitan legal systems undoubtedly materializes this Anglo-American phenomenon of penetration of the economic dimension in the legal sphere. In addition, several Anglo-American contractual mechanisms are imported into the the projects of unification of the law of international contracts ; the effectively convey the legal philosophy of the common lawyers. The integration of Anglo-American rules has resulted in a strengthening of the guiding principles of freedom and contractual loyaulty, as well as weakening of the principle of contractual security

▼ It is believed that good design should not only satisfy users’ needs, but also improve their overall quality of life. Nowadays, with the rapidly increasing amounts of time spent on the internet, more and more people, the majority of them youngsters, claim themselves as otakus since they cut themselves off from face-to-face communication. From my primary and secondary user studies, most otakus have difficulties interacting with strangers in real world contexts, but some do want to expand their social networks. This design hypothesis is to provide opportunities for otakus to meet people and build friendships in real life. The purpose of this thesis is to use design methodologies to accomplish this hypothesis. The objective is to adopt design approaches to enhance the connections among otakus in face-to-face scenarios by incorporating what is learned from research on and with the target group. Based on the analysis of the user group who regard themselves as otakus, my final design adopts a user-centered approach in order to accurately address the problems. Previous otaku studies are valuable and inform this interaction design. Yet with such general information as a guide, it is still essential to identify the otakus users’ needs and problems they face in their daily routines. Therefore, I conducted a survey to learn about otakus’ social-phobias techniques skills and needs.
The interview data provided more detailed information to identify user requirements and needs. According to the survey data, 79% of otakus are willing to meet more friends in real life, which indicated that most otakus wanted to meet more people in real belief as long as they are able to choose where and when to meet, as if they were playing a game. They lack the face-to-face communication practice with live people in various scenarios.
The mobile phone is the best medium to reach out to otakus; cell phones are the most highly-used electronic device of all screen technologies. Thus, this design thesis developed the mobile app “Say Hey,” a social app with a role-playing game format. “Say Hey” a social app with a role-playing game platform. Using this app, otakus will act as game characters and finish a set of tasks, which involves offline entertainments, including interacting with their physical surroundings. In this way, participating otakus will start to connect the virtual world (mobile application) and the real world (offline activities). By using this app, they will have to collaborate with other people to finish tasks, which will connect them with other players and people in real life, starting a trivia challenge. As a result, the objective is that Say Hey will improve their interpersonal communication skills. The ultimate design goal of this thesis project is to help otakus gradually get involved in real society and frequent interpersonal communications in daily life.

Background
Chiropractic is practiced in over 100 countries and is considered to be the fastest growing health care profession internationally. Several studies investigating the practice characteristics of chiropractors have been conducted in selected countries, however, as far as is known, no study has been conducted where chiropractors from countries across the globe are assessed for their practice characteristics in order to determine if regional differences exist. Gaining insight into chiropractic practice and its influencing factors, relating to both the profession itself and the chiropractor can enable organisations such as the World Federation of Chiropractic to have a greater understanding of how chiropractors are currently practicing and how the profession is being utilised by the public. Improved insight into the profession provides a baseline description for the public and other health care practitioners to fully comprehend what chiropractors can offer to the health care system.
Aim:
The aim of this study was to determine the demographic profile and practice characteristics of chiropractic delegates attending the World Federation of Chiropractic’s 12th Biennial Congress 2013.
Method
A pre-validated questionnaire and letter of information and consent was distributed to all registered chiropractic delegates (N = 406) attending the World Federation of Chiropractic Congress in Durban, Kwa-Zulu Natal 2013. The questionnaire was part of the delegate packages and they self-selected to participate. Due to a low response rate at the congress, the questionnaire was made available electronically on Survey Monkey®, for six weeks after the congress. Questions relevant to this study were coded, reduced where necessary and utilised for data analysis with IBM SPSS Version 21. Descriptive data was then summarised and presented using tables and graphs. The study was approved by the Durban University of Technology’s Institutional Research Ethics committee.
Results:
The response rate was 34.72%, with 52.5% being female, mean age was 42 (SD ± 13years, and all seven geographical regions were represented. The majority of respondents were from Africa (51.1%), followed by North America (22.7%) then Europe (14.2%). South Africa (48.6%) was the most represented country. Respondents held either a Master’s degree in Chiropractic (51.8%) or a Doctor of Chiropractic (DC) degree (48.2%). The mean years since graduating as a chiropractor was 15.7 years (SD ± 3.6). The majority of respondents (71.2%) engaged in full-time clinical practice, for between 5 to 15 years (39.8%) with 51.4% purporting to have an evidence based philosophical approach to practice. ▼ This thesis is intended to Greek environmental terminology, its relations to the respective English terminology and its use in legally binding texts, such as international conventions. The starting point of the theoretical part of the thesis is the subject field of terminology and, in particular, objects, concepts, designations and languages for specific purposes (LSP). Additionally, the state-of-the-art of Greek environmental terminology is discussed, along with parameters influencing it (need for the creation of relevant terms, for relevant education, for the compilation of relevant dictionaries etc.), whilespecial reference is made to the (ancient) Greek language and its contribution to the formation of terms. Finally, a first approach concerns the language characteristics of conventions (style, terminology, translation, etc.) and how environmental terminology is integrated in them. In the second part of the thesis, the study focuses on a particular convention, namely the Aarhus Convention, where some translation problems/ issues are presented that arise from the translation of environmental terminology, along with the impact of given translation choices in the perception and understanding of the text. The discussion initially focuses on general translation issues, while in a next step the English environmental terms appearing in the Convention are presented, mainly those that have dual or multiple translations in Greek target texts. Analysis of these terms is made by means of tables, where the degree of Greek terms’ conformity with the term formation principles is investigated, according to the specification of relevant ISO standards. At the same time, the translational efficiency of each term in the Greek text is assessed and, if the Greek translation is deemed unsuccessful, insufficient or unacceptable, an alternative one is proposed. Finally, reference is made to the omission of surface elements during translation and to source-text environmental terms that have been rendered in the same way in the Greek target text. The conclusions drawn from the processing of the research material highlight the need for more extensive involvement with environmental terminology and include registering and consolidating the environmental terms in use by creating, inter alia, a National Agency of Terminology, which will work uninterruptedly, as well as by gathering and improving translation tools.

Sponsorship of business-to-business conferences is an effective marketing tool available to companies targeting the business market. However, as with any other marketing tool, there are various factors that influence the degree to which business-tobusiness conference sponsorship will be effective in contributing to the achievement of a company's strategic marketing objectives. For this dissertation, the research problem is that sponsors do not seem able to accurately measure the degree to which business-to-business conference sponsorship has been effective in achieving their marketing objectives. If sponsors do not know how effective sponsorship has been in achieving their objectives then they cannot make informed decisions about future sponsorships. The purpose of this study therefore, was to examine the evaluation of business-tobusiness conference sponsorship and explore the extent to which sponsors evaluate the degree to which sponsorship has met their marketing objectives. A research survey was conducted amongst senior managers responsible for marketing decisions within their organisations. The findings of the research showed that 17% of respondents did not set objectives to be achieved though their sponsorship of a business-to-business conference. By not setting objectives, it is unlikely that companies will be able to accurately determine whether the money spent on sponsorship was justified or not. A further 13% of respondents that did set objectives did not measure the extent to which the objectives were achieved. The researcher identified eight primary marketing objectives of business-to-business conference sponsorship. These are: Increasing awareness Positioning Sales Niche marketing iii Entertaining clients Database building Networking and forging new business relationships Conduct market research It was found in the research that the most commonly mentioned method to measure the extent to which business-to-business conference sponsorship objectives had been achieved was using a sales-related measure, for example sales revenue. However, the majority of respondents (60%) also indicated that it was "strongly unlikely" that sales objectives could be achieved through business-to-business conference sponsorship. It is interesting that the majority of respondents (48%) believe that it is the "fault" of the sponsors themselves that their marketing objectives have not been achieved by sponsoring a business-to-business conference, while 30% believe that the "fault" lies with the conference organiser. This report concludes with recommendations for both sponsors and conference organisers about how to improve the effectiveness of business-to-business conference
