Resumo: A coleta de s?men post mortem levanta quest?es ?ticas e sociais. Neste estudo relatamos dois casos testemunhados pelos autor nas suas atividades em uma Organiza??o de Procura de ?rg?os no Brasil. Os pacientes tiveram o diagn?stico de morte encef?lica, eram doadores de ?rg?os e n?o apresentavam consentimento para a utiliza??o de esperma. No Brasil, o diagn?stico de morte encef?lica est? claramente estabelecido desde 1997, com atualiza??es constantes, tendo a ?ltima sido feita em 2017, mas sem considerar a possibilidade de coleta de esperma ou ?vulos do doador. A quest?o de solicita??o de material germinativo para posterior utiliza??o em reprodu??o humana assistida vem gerando quest?es ?ticas e morais em toda a sociedade. Uma revis?o na literatura mundial foi realizada, bem como na legisla??o atual em diferentes pa?ses, incluindo o Brasil, com aten??o especial ao impacto na autonomia do falecido, no interesse do solicitante, no caso a esposa ou familiar, na gera??o da crian?a e seus direitos e no papel ?tico do m?dico e da sociedade; Abstract: The collection of post-mortem semen raises ethical and social issues. In this study we report two cases witnessed by the author in their activities in an Organ Procurement Organization in Brazil. The patients had a diagnosis of brain death, were organ donors and did not have consent for the use of sperm. In Brazil, the diagnosis of brain death has been clearly established since 1997, with constant updates, the last being done in 2017, but without considering the possibility of collecting sperm or donor eggs. The question of requesting germinative material for later use in assisted human reproduction has generated ethical and moral issues throughout society. A review in the world literature was carried out, as well as in current legislation in different countries, including Brazil, with special attention to the impact on the autonomy of the deceased, in the interest of the applicant, in the case of the spouse or relative, in the generation of the child and their rights and the ethical role of the doctor and society Advisors/Committee Members: Boin, Ilka de Fatima Santana Ferreira, 1953- (advisor), Filho, Gaspar de Jesus Lopes (committee member), Saraiva, Jose Francisco Kerr (committee member), Dantas Filho, Ven?ncio Pereira (committee member), Zambelli, Helder Jose Lessa (committee member).
