Abstract The differences between Constitutional Right to Work and general Constitution Rights are, one may exclude illegal Public authority, especially when it comes to the violation of Constitutional Social Right, the Infringement may seek relieve through Public authority. Under our Constitution Law system, Rights to Work are commonly considered as the Right to Survive and the Right to Work according to Constitutional Law Act 15. Therefore, the Right to Work grants the government to take the initiative actions to ensure peopleâs right. Seeing the Right to Work as a driving right in a subjective way can be controversial. Although viewing the true facts, the government may nguarantee zero percentage of unemployment; one may not over intervene the free marketâs allocation toward Jobs. The Constitutional Law Act 152 claims that the government should at least provide job-tutorshipâs opportunity, as a Constitutional commission. As the best suitable interpretation for the characters of the Constitutional Right to Work, Council of Grand Justice provides basis. As for the three Labor Working Rights ; the Unity Right, the Negotiation Right and the Dispute Right are mainly discussed. The three Labor Rights listed as above will be discussed base on the Japanese Constitution Laws, since they are stated plaintext and are without law holdings. On the other hand, our Constitution supports the discussion of the three Labor rights with Constitutional Law Act 15 and 22, the Basic State policy, along with the Council of Grand Justice. Also, Labor Standards Act, Labor Union Act, Collective Agreement Act, Act for Settlement of Labor-Management Disputes are all laws involved with Labor Rights. All laws should obey the rule of proportionality under the Constitution. As a matter of fact, our Labor Rights are specifically stated in our laws. In the following article, the basic values through our Constitution will be used to examine the problems which the Right to Work may face today in our society. To form specific and virtually indemnification; not only with the complete laws, but also in need with the co-working between the Legislation, Judicial and Administrative, one may truly seek to achieve its Constitutional Right to Work. Abstract In respect with research on the regime of the old age economic security, this dissertation primarily propose some issues as to what foundation of philosophical method is for the old age economic security, what ideology is for this regime, how the personality is to be asserted for protection of the old age economic security, what indemnifications in the light of the constitution and rules are implemented, how to allocate resources in order to facilitate equal of the generations and personality development free under the limited financial resources, and how to achieve a sustainable development of the pension system in view of changes of economic and demographic structure. Moreover, comparing with standard and framework of the international organizations, this dissertation would like to further explore whether the old age economic security regime in our country follows international organizationsâ criterion as a golden rule or international standards are only regarded as reference in our regime. Following above raised issues, this dissertation think that it should be discussed whether our the old age economic security system is prefect enough or this system need to be amended as well. Based on the above-mentioned consciousness, this dissertation adopts core essence of the old age economic securityâresponsibility and income support as a starting point. First, I would analysis the contents of constitution by methodology of philosophy of law to explore the explicit and implicit meaning for the old age economic security therein contained. Second, I use methodology of philosophy of law and political science to ascertain the necessity of the presence of personality and its legal hierarchy, to discuss constitutional basis on the protection of living of senior citizens in order to understand protection of dignity and living in the constitution which is legal basis for the old age economic security regime, and to express how to adopt appropriate measures in accordance with the principle of equality, the principle of diversity, the principle of proportionality, justice of generations and sustainable development. Furthermore, this dissertation also focuses on the issues of retirement income replacement rate, option of pension plan and risk diversification to clear their weak points and make some recommendations. Whereas the old-age society is a global issue, International Labor Organization and World Bank both take serious view on it and provided frameworks and advices of the old age economic security respectively. Therefore, this dissertation also deeply discusses our countryâs current regime and compares with the above-mentioned international regime to clarify our shortages and provide some recommendations. By way of research above issues regarding the old age economic security, we may say, the old age economic security regime is a diverse and complex system which contains wide sphere included social policy, labor policy, family policy, population policy and economic policy such as.
