▼ The aim of this thesis is to discuss the seven bilateral foreign trade and economic cooperation agreements (including transitional agreements) signed by Taiwan, all of which in force: âFree Trade Agreement between the Republic of China and the Republic of Panamaâ, âFree Trade Agreement between the Republic of China (Taiwan) and the Republic of Guatemalaâ, â Free Trade Agreement between the Republic of China (Taiwan) and the Republic of Nicaraguaâ, â Free Trade Agreement between the Republic of China (Taiwan), the Republic of El Salvador and the Republic of Hondurasâ, âCross-Straits Economic Cooperation Framework Agreementâ, âAgreement between the Separate Customs Territory of Taiwan, Penghu, Kinmen, Matsu and New Zealand on Economic Cooperationâ, âAgreement between the Separate Customs Territory of Taiwan, Penghu, Kinmen, Matsu and Singapore on Economic Partnershipâ as well as the political economy analysis of the change in the name used by Taiwan as a signatory and in the contracting parties. This thesis is divided into five chapters. The first chapter includes a summary statement of the background in this research and the major discussion points; the second chapter reviews incidents of Cross-Strait governments fighting for "name rectification" in the international community and follow-up responses to find out an appropriate theory model; chapter three traces back to the source of the problems and to look at the Cross-Strait relations in a historical context; the fourth chapter examines the economic and trade relationship between Taiwan and its seven trading partners based on the statistics of economy and trade. In conclusion, the study found that regardless of what kind of foreign affairs Taiwan is dealing with, be it to name, to rename, or to look for a new identity, all of the policies were aimed at avoiding the enforcement of the central-local relations between Cross-Strait governments in the international community. Under this proposition, we can find that our decision-making behavior in dealing with foreign affairs in different periods is consistent. By the Name-Status Order Theory application, we found that the early fight between the Cross-Strait governments for âChinaâs representationâ is largely based on the traditional âChina ideologyâ, which can be attributed to the differences in values between the two parties. Since Taiwan has withdrawn from the United Nations, it is being pressured not to use its official name or the name âTaiwanâ which emphasizes the independent status of both parties. This trend has deepened the recognition of âTaiwan identityâ, which has forced Taiwan to be in the grey area of âinheriting the traditional orthodox legitimate principlesâ and âgoing independenceâ. This is in fact a strategy to reap practical benefits in expense of its own identity in order to maintain the foreign affairs relations with other countries. ▼ Due to the globalization processes , international trade has increased dramatically, resulting in growing number of disputes between companies from different countries. Effective and convenient way both to prevent and solve the conflicts is international arbitration. But if failing party does not voluntarily accomplish the award, the other side must apply for a special international procedure - recognition and enforcement of the award. The United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958 is the main international treaty to instruct the process of enforcement of arbitral awards and arbitral awards may be refused only under certain grounds laid down in the Convention. This paper is mainly focused on the award enforcement procedure in one of the biggest commercial markets of the world - China. According to the previous research, enforcement procedure in China has improved recently, however it still can not meet international standards. In this paper we examine the procedure of enforcement first, moving from the available form of arbitration and process of choosing arbitration rules to behavior of the state as a part in the process. Then we introduce the article V of United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958, as a most important document for practical implementation of enforcement. In order to understand current situation in China, author thinks it is necessary to make a short review of historical development of arbitral award enforcement system and legal basis relevant to the main purpose of this research. Finally, we analyze the present legal situation in China within the mechanism of recognition and enforcement of arbitral awards and show what kind of problems exist when it comes to practical realization of enforcement in China. Our analysis shows that the main problems with practical enforcement in China include: local protectionism and different understanding of the definition and purpose of Public Policy. These problems are also illustrated by practical cases, which happened between Chinese and international companies. Our conclusion shows that mentioned problems are not connected with international mechanism of arbitral awards, but with the complications of its implementation in China. Some of the problems can be solved if involving party prepares thoroughly for the process, but some of them can be solved if central and local government of China stops maintaining its policy of local protectionism. ▼ In 2007, Chinese Government has established the first sovereign wealth fund in formal and funded with $2,000 billion dollars which called as China Investment Corporation(CIC).It is purposed to settle the bad debts of State-owned Bank and process the restrcuting of financial management system. At the same time, CIC invest overseas investment actively. The Chinese Government treats the sovereign wealth funds as a vehicle, positively to establish the strategic reserve system for energy and raw materials. Except to hedge the volatility of international market price,in the other hand, to optimize the Chinese industrial structures to be more efficiency. But, in beginning stage of China's sovereign wealth funds, they faced the problems with other state-owned enterprises in overseas investments.It happens the group-overlapping effect and huge losses when deals with multinational enterprises,and it caused the dosmestic critisms . However, China's sovereign wealth fund set up by the time is not long, mostly of the chinese scholars have proposed a strategy as âFund Exchange for Technologyâ .It is through the usages of China's foreign investment to acquire the resources and technology. On the national development strategic, the China's sovereign wealth funds which controlled by the Chinese Central Financial leading group, are responsible to execute the national missions.In addition to the country's political security,economic security,it also to ensure the food security,energy security,water resources, and other important resources. Clearly, political motivations and core technology is the Chinese Government's core interests, which is China's national security and sustainable development. This article is researching into the core interests for the Triangular Strategy of China`s Sovereign Wealth Funds. In the raising of the "Strong Power" of China , national security issues are priority to be settled .Acquisition for the "Power Composition" ,which included the key technolgy and resources , and Chinese government is facing the main challenges.Would the China's sovereign wealth fund still keep investing although it occurred huge losses in overseas energy procurement,acquisition of dosmestic and abroad enterprises, financial assets, investment activities of configuration? Comparatively, would the CIC continuing to expand and investing with "trianglular strategy" to achieve the core interests.In general, keep the subsequent to focus on the economical discourse power and the core technology. ▼ Generally speaking, in an international multilateral trade organization, the behavior to give mutually and unconditionally the most-favored nation treatment or the permanent normal trade relation is deemed as a fundamental principle. However in the case of Jackson-Vanik Amendment violated evidently the mutually favored non-discrimination international commerce principle in the non-market economy countries such as China on the yearly deliberation; especially when the American Government and China reached the bilateral agreement allowing China to join the committee in 1999; based upon the whole entity benefits of economy and commerce for both America and China and also to avoid the conflicts between the domestic law and the international standard, the legislation giving China PNTR was thus produced. However, because the legal Act was of important significance to discontinue the yearly deliberation on China, thus the standpoint of domestic civilian voters appeared big contrast which led to a serious legislation deadlock. Briefly speaking, the legislation background of America giving China PNTR is filled with various stages of benefit conflicts between America and China, American Government and the Congress, and the American domestic beneficial groups. According to the concept of Two-Level Games Theory by Robert D. Putnam, we could find that American government on one hand was forced by the pressure of international environment to have the diplomatic measurement of PNTR, and on the other hand it also needed to face the legislation obstacle which is produced by the congress, beneficial groups and the civilian voters. Nevertheless, the policy of giving PNTR to China is finally successful, among these except for the policy manipulation to seek for the domestic approval, the participation of transnational corporations also functions importantly. Based upon these, this study takes the point of view to integrate both the Two-Level Games structure and the political participation of transnational corporations to analyze the inside and outside influencing factors during the process of PNTR, and further explain whatâs the possible international and domestic limits to face with when America gives non-market economy nations PNTR under two-way interactions of both international diplomacy and domestic politics. Furthermore if limits exist, how is the PNTR policy finally settled by the influence of transnational corporations? Try to further provide a relative study from another angle to have a dynamic analysis path for the American economy and commerce diplomatic policy. ▼ With the recent trend of regional economic integration, even Republic of China (Taiwan) has not been the major part of the regional economic integrations. Taiwan is inevitably not excluded by the effect of integrations. Further, there has been a gradual decrease both in exports and imports of Taiwan, followed by the plunge of FDI in 2015, great sign has been aware Taiwan of the significance of the regional economic integration. Especially the problem of export reliance on Chinese markets has prudentially needed TPP as a leading role to balance Taiwanese trade and investment ratio. However, for every plus there is a minus, while the high-standard TPP agreement seeks to remove NTBs and sensitive sectors, it will bring some impacts to domestic industries, also some potential opportunities for export engine stimulation, investment incentive, and industry upgrade. In order to display Taiwanese determination, regardless the possibility of Chinese factor, to participate in TPP agreement and second round negotiation, Taiwan needs to track the development of TPP, follow up the update of TPP, and is better to embark on regulatory revolution in advance of TPP agreement. A well-round preparation work is needed to lower the cost of industry adjustment for TPP reliance, especially as the paper has found that the TPP negotiation conclusion has lowered the high-standard claimed by the U.S. initially. Hence, the paper has articulated both outer and inner sides of barriers to join TPP as preparatory work. In outer part, Taiwan needs to preliminarily deal with the current negotiations with the US and Japan, then seek for the supports of other TPP countries which may allow a differentiation of negotiation conclusion. In inner part, where the fundamental resolution is, Taiwan has to undergo a self regulatory revolution, including Taiwanese edition of TAA, intensive safe guard measures, transparent regulatory coherence with GRP and RIA system, and defined policy with executive ability. The later Taiwan joins TPP, the higher price the domestic industries have to adjust the impact, and less added-value can be created among the TPP supply chains. Judicial Yuan actively carried on judicial reform and spread âLay Participation in Trailsâ, then announced âDraft for Provisional Act Concerning Lay Participation in Criminal Trialsâ on Jan. 11, 2012.The research purpose of this thesis intends to discuss controversies about whether Taiwan should introduce âLay Participation in Trailsâ or not and which model should be chosen.First, I discuss from the history and goals of trials and the theories and functions of lay personsâ participation, then the origins and developments of the Jury System, and the real situations of Jury System in U.S. After that, in order to understand the controversial opinions and the differences, I review the Taiwanâs judicial reforms processes about lay personsâ participation and all the concerning drafts. Finally, I form my opinions and advices according to local experiencesâone simulated case in Taiwan Kaohsiung District Court, hoping to offer some useful evaluations and suggestions for the future system. My essay turns out that the key point which the administration can introduce the lay participation in trials system into our criminal procedure smoothly is most of citizens could fully empower the judges perform the duty of trial without worrying. What kind of related models chosen bases upon whether the citizens trust the assessor or not. No matter what kinds of lay participation in trials system chosen, supporting measures are necessary, however.Furthermore, it is essential that the legal educations are popularized within the whole nations, especially in young generations.In addition, the elements which put this system in practice well are the enthusiasm of the citizens for lay participation in trials and the sense of honor.It is hard for our government to adopt lay judge system in the near future as result of lack and inadequacy of judicial climate, resources and relevant coordinative measures.Nevertheless, I am strongly convinced that we should get behind lay judge system.The reinforcement of the system should postpone until the preparations are set up, including acceleration of legal educations for every member in our family,schools and society.By means of deepening our education regarding rule of law, people could be cultivated to be honored to take part in judicial system. Thus, it is definitely attainable that we will set the step in the field of lay participation in trial in the foreseeable future smoothly. ▼ Since 1980s, the cross-strait interaction has been increasingly deepened. The rise of China has brought huge business opportunities. As a result, economic and cross-strait trade, investment, industrial division and other trade relations become closer. However, because of the political sensitivity of cross-strait relations, the cross-strait economic and trade interaction is always conducted by means of nongovernmental, indirect and uniderectional mode. In addition to Taiwan's existing huge trade deficit with China in trade relations, it also exists vast trade surplus in investment relationship. Such non-reciprocal trade relation is abnormal in the era of globalization, and has an impact on Taiwanâs resource allocation in various production projects and is detrimental to the country's sustainable development. Moreover, Taiwan and China have joined the World Trade Organization (WTO) one after another in 2002. Many of the principles under the WTO framework, such as the principle of national treatment, most-favored-nation treatment principle etc., are forcing Taiwan not to avoid the normalization of cross-strait economic development. Allowing Chinese investors to invest in Taiwan as an important policy constructing normalization of cross-strait economic and trade relation involves Taiwan's sovereignty, national security and other sensitive issues. This study explores the policy allowing Chinese investors to invest in Taiwan separately on three principal axes: Firstly, it researches China's policy trend of extending external investments, and depends on such context to analyze Chinaâs strategic implications of trade with Taiwan in terms of Chinaâs investment in Taiwan; Secondly, the regional economic integration in East Asia has brought Taiwan economic and political marginalization risks, the cross-strait asymmetry trade and investment dependence relations have caused outward relocation phenomenon of Taiwan's industry. In addition to the above changes in the external and internal environments, the two sides have many principles needed to be followed under the WTO framework. In summary, Taiwan can no longer take the foregone discriminatory measures toward China-invested enterprises; finally, it explores Taiwan's security considerations in terms of Chinaâs investment in Taiwan, summarizing the evolution of policy allowing Chinese investors to invest in Taiwan, examining the results of such policy and the obstacles it faces, and using the United States âForeign Investment and National Security Act âfor reference, proposing recommendations for Taiwanâs follow-up policy allowing Chinese investors to invest in Taiwan. ▼ Taiwan and China have once shared mutual historical background and both of them own similar races, languages and cultures. All the above reasons make them inseparable from long time ago. Though democracy creates distinct society of Taiwan from one created by Chinese communism , both sides braves the stable force from education despite different political systems.The phenomenon indicates the importance of educational policy and revolution by both sides, particularly instructors, the heart and soul of execution. Therefore, the author hope the thesis can conduct not only the merit system of instructors and the revolution of their rights and obligation of both sides, but also more of Taiwanese and Chinese policies for instructors and systems for education from the comparison and analysis.The thesis analyzes and differentiates Taiwanese and Chinese merit system as well as rights and obligation for instructors. The main method is comparative research by polish educationist George Bereday and also literature review will be used to collect needed documents or bibliographies. The development and revolution of merit system as well as rights and obligation for instructors are involved. ããThe conclusion for the thesis is briefed as follows:(1)Both Taiwan and China requires educational background for instructor qualification. However, one loses qualification if he/she fails to obtain diploma in Taiwan. In China, one could still qualified as instructors for schools at any level through national teacher qualification certificate examination even if he/she fails to obtain diploma.(2)In Taiwan, test and examination are two ways to qualify as instructors. Test is for instructors qualifies for senior schools and below, two rounds are required. Examination is for instructors for Junior College and above, two rounds are required. In China,qualification for instructors requires application regardless of schools for all levels.(3)Both Taiwan and China implement appointment system for hiring instructors. However, the vast territory and serious influence peddling in China preventes the implementation of appointment system.(4)For rights of instructors, Taiwanese instructors assures right to profession association, right to educational neutralism and right to counsel for business lawsuit.(5)For obligation of instructors, Taiwanese instructors are under obligation to confidentiality and to be homeroom teachers. As for Chinese instructors, they are under obligation to tutor patriotism and to teach political thoughts.(6)Laws have already been made for instructors on merit system as well as rights and obligation for both Taiwan and China.(7)In regard to merit system as well as rights and obligation for instructors, division still lies between regulation and operation for both Taiwan and China. At the same time, Chinese leader had also exercised of stability-maintenance and sovereignty-maintenance over the South China Sea Islands. Facing the pressure of Chinese actions are resulting regional powers are unbalanced in the Asia-Pacific. The Philippines sought to attach to the great power of the United States politics and military. In addition, the Philippines applied the United Nations Convention on the Law of the Sea and multilateral diplomacy to negotiate with China to execute the Declaration on the Conduct of Parties in the South China Sea. However, China insists that resolves solutions through bilateral relations between China and the Philippines and preventing the Philippines from seeking ASEAN member states are involved in the dispute because that is not profitable to China. Therefore, China and the Philippines cannot reach a consensus, and the South China Sea disputes are increasingly becoming more intense. In 2016, the South China Sea Arbitration made the Philippines turns the tables on their sovereignty in the South China Sea, which achieved equal status for the Philippines and China. Also, the South China Sea Arbitration made China bear the pressure of international law and ethical standards, and the United States be able to have freedom of navigation in the South China Sea. In fact, the sovereignty disputes in the South China Sea have always been under the arena for strategic competition between regional and international nations. In June 2016, Manila joined hands with Beijing and set aside the dispute in the Spratly Islands after Philippineâs new president Rodrigo Duterte. Additionally, the Philippines returned the bilateral consultative mechanism with China that will joint development in the South China Sea. The Philippines wanted to separate from the United States was due to preserving their autonomy. It also hopes to balance the relationship between the two powers of China and the United States, to maximize profits for the Philippines, and try to find a favorable national survival and development strategy. ▼ Taiwan and Mainland have been under two separate administrations since 1949. Since then, each side has developed its own economic and legal system. Over time, as cross-strait restrictions have been lifted, crimes such as transnational smuggling, drug trafficking, and fraud have increased. At the beginning of 2011, a gang including Chinese and Taiwanese used a telephone scam to cheat people of their money in mainland China. Soon after, 14 Taiwanese suspects were deported from the Philippines to stand trial in China, triggering public debate. Which side shall have jurisdiction over this criminal case based on the international conventions? Some experts in our country insisted on our jurisdiction over this case. However, is it rational or just for populist sentiments? The purpose of this thesis is to study the jurdisdictional conflict between the two sides of the Taiwan Strait and to find the solution. What is the actual content of principles of international criminal jurisdiction, such as territorial jurisdiction, national jurisdiction, protective jurisdiction and universal jurisdiction? What are the domestic and international practices of foreign-related criminal cases? This thesis discusses the issues in such cases arising from a conflict of jurisdiction, including the cause, type, rational standards as well as dispute settlements for conflict resolution. All of these provide good examples for resolving cross-strait criminal jurisdiction conflicts. Today neither side of the Strait recognizes the otherâs sovereignty, and both deny each otherâs administrative powers. Both believe that their jurisdiction extends over the areas where the other side has sovereignty. This belief is supported by legal statutes and the court opinions of both sides. As people on both sides of the strait begin to call for an application of âNo Double Jeopardyâ, accompanying with trends in offense diversification, it is natural to assume that numerous jurisdictional disputes will occur. This thesis analyzes the cause, scope, feature and definition of conflicts of law between Taiwan and mainland China, and tries to suggest a concrete method to reconcile the conflicts arising from issues of cross-strait criminal jurisdiction. The conclusion from this paper is that the best resolution for cross-strait criminal jurisdiction conflicts is to sign an agreement on mutual jurisdictional assistance. Possible agreement clauses are provided for future policy reference and decision making. ▼ Due to declining of birth and school-age population, they caused an impact on all aspects of the social structure, economic development, population policy, education and culture. Because private schools are oversupply, caused by insufficient number of students, difficulties in the operation of the school, especially in the higher education stage. The Ministry of Education response to the problem of low birth-rate and reduce the impact on schools, plan to start University shuts down mechanism, and to develop the indicators, includingï¼1. insufficient school enrollment or student registration rate is too low; 2. bad evaluation results; 3 long-term staff salary arrears; 4. excessive teacher turnover and retirements; 5. poor financial situation in accordance with the financial forecasts; 6. curriculum planners and improvements submitted did not pass ; 7. The fact that there is illegal and so on. However, private school shuts down is very huge impact on people's rights and interests. It not only against the student's Right to Education and The Right to Learn, teachers also infringed the right to work and the school's property, but there is no correlated regulations or authorization, only by the evaluation result, the number of students, teacherâs separation rate and other indicators. ▼ Not only is it the case that goods and merchandise transfer more easily under globalization but persons travel more freely as well. As a result, certain external costs have emerged, with criminal activities being one such cost. With the development of trade development between Taiwan and mainland China (hereinafter referred to in terms of âcross-straitâ), the interaction between trade, the economy, social and cultural activities have enhanced over time, and external costs have resulted. Among such external costs, fugitives and extra-territorial organization crimes have slowed the pace of cooperative development. The two sides signed the Cross-strait Joint Crime-Fighting and Judicial Mutual Assistance Agreement (hereinafter referred to as the Cross-strait Mutual Legal Assistance Agreement) in April 2009. Whether the two sides can continue their mutual assistance in criminal matters based on the existing foundation of their judicial cooperation has been attracting attention since May 2016. The Peopleâs Republic of China has been transforming into one of the most influential powers in Asia and the world. Meanwhile, cross-strait relations have grown closer following the signing of 20 economic related agreements and the Cross-strait Mutual Legal Assistance Agreement. As a result, some have attempted to explore and discuss cross-strait relations from different aspects, such as Realism, Liberalism and Constructivism.While trade relations have been strengthening, both sides across the strait have faced the challenge of combating cross-strait and international crimes. As the issue of fugitives transcends borders, this study focused on the cross-strait extradition and repatriation of fugitives in the frame work of the relevant mutual legal assistance in criminal matters. By adopting empirical legal research methods, this paper researched relevant rules relating to international mutual legal assistance in criminal matters, before analysing and comparing these with the main extradition and repatriation issues in cross-strait relations. Furthermore, by adopting the "Constructivism" approach of international relations, especially one based on Alexander Wendtâs theory, this paper attempted to observe whether common knowledge and cultural change, as well as the four variables of collective identity, have emerged in cross-strait cooperation in criminal matters. Wendt has proposed that there are three different types of culture and that each culture has three different degrees of internalization (compliance, self-interest and legitimacy), which determines how deeply embedded states are in that culture. Therefore, this study explored different types of culture depending on different ruling periods, evaluated what factors caused cultural structural change and which degree of internalization describes the Cross-strait Mutual Legal Assistance Agreement. Based on these observations, this study discussed whether four variables of identity have the potential to emerge in this judicial cooperation field.
